Dwight Brookes begs court to pay fine after birthday!
Brookes, 29, pleaded guilty on a previous occasion to the charges of resisting arrest and using indecent language on July 28, 2013. He was accused of becoming enraged and damaging property during a confrontation with police officers, which led to him being arrested and placed before the court.
At the sentencing, Senior Magistrate Richards said that in the case of resisting arrest he could face a maximum of three years imprisonment or fined $2000 or both and for the use of indecent language he could have been fined a maximum of $500 or spend six months in prison.
Considering the facts of the matter and that the defendant was remorseful to the point of apologising to the court for wasting its time, Magistrate Richards made the decision to fine Brookes $1500 for the resisting arrest offense and $500 for use of indecent language. Failing to honour, Brookes could spend as much as four months in prison.
The magistrate also made it known that her penalty on the defendant took into consideration the fact that the acts were committed against peace keeping officers.
Asked if he had to say anything about the $2000 fine, Brookes asked to be given two to three weeks to pay as he has just started working.
However, when the magistrate told him he had until November 20, 2015 to pay, the man covered his face, then wiped it several times saying, "I was going to say that day is my birthday too, please, please, please," as he begged for a later date.
A very flexible Magistrate Richards then gave a new date of November 27, 2015 for Mr Brookes to pay his court fine.
She warned him, however, not to send any messages or call her for any extension. "Don't call me, no messages please," she said sternly.
