Crown requests Summons for Marvin ‘MB’ Blyden
When Walters was brought before Senior Magistrate Tamia N. Richards on October 27, 2015, Crown Prosecutor Mr Herbert Potter indicated to the court that he was not going ahead with calling another police witness as was initially planned, however, he requested that a Summons be sent out for Mr Marvin ‘MB’ Blyden. Blyden is wanted to take the witness stand to allow the Crown to close its case.
The charges against Mr Walters stem from a December 27, 2011 incident in which he allegedly explicitly challenged officers of the Royal Virgin Islands Police Force (RVIPF) to break open his car windows to get him out.
The charges are damaging property, reckless and negligent act, resisting arrest, disorderly conduct and reckless driving, which he has pleaded not guilty. He pleaded guilty to unlawful possession of a controlled substance and wounding. The wounding had to do with him biting someone.
On Tuesday, the Crown called to the witness stand a police officer who was on the scene of an incident that took place on December 27, 2011.
Police officer Chapman recalled that on the day in question he was at the Road Town Police Station, where he and two others responded to an emergency call at around 5:10am at Crystal Night Club in Free Bottom. On their arrival, Officer Chapman said he observed a car coming out from the club’s compound driving in a fast and dangerous manner, and swerving from side to side.
He said the car was pursued and a short distance away, in the vicinity of Quomar Trading, the car was seen crashed with extensive damages and pieces of the vehicle scattered around. The accident also allegedly resulted in a fence and a large black water tank being damaged in the process.
Officer Chapman said that upon investigating, Jahnoy Walters was observed in the car seated in the driver’s seat and that the doors of the car and windows were locked. The policeman said he called out to Walters, telling him to open the vehicle and if he failed to do so he would break it open.
According to the allegations, Walters then told the cop, “Chapman break my f***ing car glass, five hundred dollars for each one of them.” He said that after about five minutes the accused came out of the car and an altercation ensured. It resulted in Walters allegedly resisting arrest and pushing two police officers. Chapman said one of the officers had to grab the defendant from behind and both Walters and the officer fell to the ground.
The witness continued that during the attempts to arrest Walters, the defendant allegedly said, “Don’t F***ing touch me. What yall trying to hold me for?”
Walters was subsequently placed in handcuffs. A search was conducted in the interior of the car and in the front driver’s side three small bags, which were believed to contain cannabis, were allegedly found. The witness told the court Walters told him, “Whatever sh*t you find in my car I would pay for it.”
