MIAMI, Florida, USA- A new lawyer will be representing former Premier of the Virgin Islands Andrew A. Fahie during his appeal of his conviction in relation to cocaine smuggling and money laundering charges.

After being sentenced to 11 years in prison on August 5, 2024, a Notice of Appeal was filed by attorney Richard Della Fera in the US District Court for the Southern District of Florida on September 19, 2024.

Third lawyer for Fahie

Mr Della Fera explained in a separate filing that he had intended to remain Fahie’s attorney for his appeal, but Fahie “is unable to afford to pay for an appellate attorney” and asked the court to appoint a lawyer to represent him for his post-conviction proceedings.

Fahie’s trial attorney, Theresa M. Van Vliet, also asked the court to withdraw as counsel in the case, as she “was retained solely through the sentencing in this case with Mr Fahie’s understanding and agreement.”

The appeal is being heard in the 11th US Circuit Court of Appeals, where attorney Benedict P. Kuehne has been appointed to represent Fahie, according to court records.

According to The Law Offices of Benedict P. Kuehne, P.A., it engages in federal and state criminal defense law and civil litigation, and appeals throughout the United States, emphasising corporate, white collar, and complex crimes litigation, as well as complex civil trial matters.

Kuehne Law said Mr Kuehne is known as the “Iron Lawyer” for his successes and accomplishments in complex, protracted trials and appeals, as well as for his significant achievements as an Ironman athlete (140.6 miles of swim, bike, and run).

It said Benedict P. Kuehne is experienced in both trial and appellate courtrooms throughout the State of Florida and across the nation. While he is known best for his significant representations as a white collar criminal defense lawyer, he is also one of the premier election law specialists in Florida, having represented Vice President Al Gore and the Gore/Lieberman Recount Committee as trial cocounsel in the 2000 election recount trial and the appeals to the Florida Supreme Court, the Eleventh Circuit Court of Appeals, and the United States Supreme Court.

In 2012, leading a legal team, Kuehne obtained the fifth highest verdict in the United States, $155 million, for his successful representation of an internationally accomplished educator who sued as a whistle-blower for her wrongful termination.

Mr Kuehne also prevailed against the U.S. Department of Justice in a test case in which he was charged, as a lawyer, with money laundering for reviewing and approving the propriety of legal fee payments to another prominent criminal defense lawyer for representation of a high-profile client prosecuted for drug trafficking.

In a long-awaited and highly favourable appellate decision of first impression, the Eleventh Circuit Court of Appeals declared that legal fees paid for criminal defense representation were exempt from money laundering enforcement. The Department of Justice promptly dropped all charges, resulting in Ben’s immediate vindication the day before Thanksgiving 2009, Kuehne Law reported.

    He think because he hire an iron lawyer the appeals court is going to grant him an appeal? He might be granted an appeal, go back to court for a new trial and the jurors may find him guilty and the judge may send him back to prison. Dude, stop wasting money take your lick and serve the 11 years like a true man would.

Lawyer Benedict may get wealthy White people off the hook, but an average Black person is wasting their time and money thinking he can free them or get a lesser sentence. The mother and son are already serving their time and will be home before Fahie. He is just making a bad situation worse for his family if he will have a family to come home to. Without the big money he was getting, it had gone to his previous lawyer. Can his wife's income sustain their way of living or continue to pay for the apartment and education of his children? If the answer is yes, then by all means let him waste his money on his new iron lawyer.

    The prisoner can spend as much of his money he wants to appeal his conviction. No money from the BVI treasury, no go fund me requests, no loans, no borrowing from relatives, etc. He can waste all his money on fruitless appeals.

    Why are he so fixated with going through with this appeal? He seems to be listening to the wrong set of people/advise. As is now, he are likely to serve 8-9
    years and be out with his family but want to risk that and end up getting an increase of sentence, dont seems too smart a decision.

    Sometimes when you are in for more you receive less. You go before the appeals judge, new jury and prosecutors you may end up serving 20 years or life behind bars. Hope you know Andrew, if you are not from America and you mess up on America soil they are going to hammer you up against the wall.

    The Government is paying for his appeal attorney's legal fees. According to the constitution every one is entitled to an appeal. I believe he has good grounds especially with that Juror situation. If Fahie wants to fight let him fight as I am sure he knows the risk. In regards to him receiving a lengthier sentence on appeal that cannot happen as he is not appealing his sentence but it can happen if he gets a new trial.

    Fahie does not have to pay for his appeal. He’s gotten legal aid. Further, he is not appealing his sentence, he is appealing his CONVICTION. Therefore, if he’s successful in this regard, he may get a new trial, so this 11 year sentence would be out the door.
    But who knows how this appeal will turn out? We just have to wait and see.

    What is the worst that can happen to Andrew? He lost and continue to serve his time. The Iron Lawyer seems to be a public defender; no cost to Andrew. If he is a high price attorney, I’m surprised he is serving as a public defender. Moreover, Andrew has had his day in court; he has had due process under the American jurisprudence system. His regretful and unfortunate situation should be a valuable lessin for others..A wise sage notes that there are 6 days for the thief, swindler, con artist, grifter, etc and 1 day for law enforcement. Andrew has a huge fall from grace, having being at the zenith of power, crash landing embarrasing and disappointing a nation, a people, family, friends , colleagues, fellow congregationists m, etc.
