IRD Certificate of Good Standing for work permit renewals no longer needed

ROAD TOWN, Tortola, VI- The Government of the Virgin Islands (VI) has taken a decision to temporarily suspend the requirement of a Certificate of Good Standing from Inland Revenue Department (IRD) for employers as part of the work permit renewal process.

This comes into effect today, Monday, September 14, 2020, according to Minister for Natural Resources, Labour and Immigration, Honourable Vincent O. Wheatley (R9), while addressing concerns and questions from persons during a virtual community meeting last evening, September 13, 2020.

No hindrance

“I have had several discussions with my other ministers, my permanent secretaries, with the Inland Revenue Department, with the premier and everybody and what we have decided to do against our better judgement, because we should not be doing these things, we have decided to relax that requirement  for the time being.”

Hon Wheatley said the decision was taken because Government did not want to be a hindrance to businesses becoming more “viable and more profitable and functioning better.”

“So I am saying it now, we are going to relax the immediate requirement for good standing for the renewal for any work permit in general. So effective Monday go and apply to Inland Revenue and once you bring the receipt that you have applied we will accept your work permit knowing that you will not have the certificate.”

The Minister said if it is found that the Certificate of Good Standing is not good the Labour Department is going to figure out how to proceed “because a company should not be allowed to function without these things being up to date or a proper or adequate payment plan of how you are going to get yourself in order.”

Business ‘must be done right’

Explaining the reason for the temporary relaxing of the requirements for work permit renewals, Hon Wheatley said the Inland Revenue Department has been overwhelmed with the requests, resulting in a backlog at Immigration Department.

“But business in the country like businesses in any other country must be done right.

“We are in a pandemic. We have to think differently about things. One of the things that our Premier as our leader wanted us to understand is that it’s not business as usual, it is business unusual right now. We are into a new normal, a lot of things that we took for granted we can no longer take for granted.”

Hon Wheatley added that government has to tighten up on a lot of its systems to ensure that they are collecting the revenues that is due to the Territory as it mainly runs on revenues and taxes generated internally or externally.

    That will certainly help speed up the permit renewal process but does it also apply to the requirement to attach a COGS for Social Security and NHI as well?

      Those ones are easy to obtain. I got mine in two weeks. Inland revenue is the bad boy. Is two months since I applied and don’t even got a call back.

    Why did you stop the good standinh letter at the department you all do not know how some of these bosses behave that certificate is used by the worler to easure the behaviour of thebosses, Labour department re in state the Certificate of good standing it keeps your department in control and keep the workers on track BIG MISTACE

      I agree with you. A lot of our employers not paying in the tax and although it may take a while, we now know they have to do the right thing.

    While people are facing difficult times. It is good that you understand the pressure it that is placed on employers and employee as well. Next time, try come up with well thought out decisions. In addition, dont forget to follow up with this as it is important that businesses be in Good Standing and follow the laws with respect to SS and NHI.

    Dear Government

    Please investigate Governor’s Office.

    Seems like many white staff there don’t have work permits and aren’t belongers either.

    One white woman there from uk says she’s lived here for 20 years with no work permit!

    Why is she allowed to work there but not us belongers?

    Please investigate and expose their cronyism and corruption.

      And how you know this? The goveror's office UK staff does not have to get a work permit from our government. (I don't think) The FCO office is responsible for them.

      I dont claim to know the law but there are other expat persons black/white who works for the Government without a work permit (which is basically a document authorising a person to work in a country). No belonger or other status is needed as long as that person is allowed by the immigration Department. An examples are Prison and Police Officers or eexpats who are employ with the Department of Waste Management who clean the streets. They are given an immigration stamp in their passport for the period they remain employed by the Government. They loose that privilege once they are no longer employed with the Government.

      @investigate expat employees of the government don’t usually get a work permit they pay for the entry permit at immigration and get a stamp .

    All of the certificates are still required! But due to the backlog at Inland Revenue, Labour will accept a payment receipt for the time being, so that applications may be submitted.

      You right about the non-compliant local businesses. I know an individual whose boss has been religiously taking out his contributions for over THREE years and not one red cent paid over to NHI. This is where these departments need to step in and take legal action against these unscrupulous bosses.

        I know of one case where the employer has deducted the tax etc from his workers but has never paid the money to the government for 17 YEARS. He has the same name as many of the self appointed great and good.

    You are still asking for receipts....... so it is still needed. Wrong choice of words.....

    You really saying make sure you pay for the Good Standing $50 each certificate goes a long way for government. This is whats bringing in revenue hence why when I submit my docs NO one will be making over 10,000 a year. Ha!

    A smart decision but a policy which should never have been implemented in the first place. Need to target the directors and owners of the non compliant businesses rather than the employees. Its like dealing with organised crime, no point just keep picking off the low level targets if the people behind it all can still keep operating without any fuss

    So Inland Revenue taking 2 months and yet the government say people who want to return will be allowed free quarantine in september. This law came out 1st of september and inland revenue taking two monrhs. So what does this tell you? That expat are doomed to pay fir their quarantine. Please fix this.

    Well one of the requirenents for expats to return is that their workplace produce all the good standing certificates from the various tax places. The same government said that anyone returned to the BVI before the end of September will get free quarantine. The inland revenue dept is taking more than two months to provide their certificate. So that tell you that expats cannot returned before september month end and they will be required to pay full quarantine fees when the non expats were quarantine for free. This is soo logical.

    That makes no sense because every employer should be in good standing before receiving renewals. Why would Government not enforce this and make sure that the process is dealt with differently. Labour, Immigration, Social Security, NHI and Inland Revenue should all be linked.

      Absolutely correct, why are they all not linked and be able to find out which company is paying each department? I'm no Einstein, but surely to have the businesses apply for their Good Standing Cert. when they are issued their trade licence before it is approved would make sense?? Employees don't make the contributions to these Gov departments, the business owners do. They are the ones that can potentially rip their own country off? I've been here long enough and sadly seen too many employees screwed over by their employers - by not paying SSB, IRD etc. They hold the power, make them prove their good standing.

    U see change dont happen over night u all rushing thing to much....come november and the border is still close for tourist look people leaving like rice grain to go home come december that time will be to late because the people on work permit will be gon and not all off them will come back..some off u will say who care.but always remember k never k till he back break.....

    My thoughts were always that the Government, specifically Trade Dept should not renew Trade licenses, without persons showing Certificates of Good Standing for NHI, SS and PAYE ( Inland Revenue)
    In this way once a current and valid Trade license is attached to the Work Permit renewal, then Labour Department knows that this business is in good standing.

      I totally agreed with this. Once a year when renewing your trad license make sure all these certificates are up to dates. I can see that the government need help from the man on the street.

      Really good idea although they would end up having to roll it back once it becomes clear just how many businesses owe money to Inland Revenue. It is right though as how can a Government department issue a certificate of good standing and trade license renewal when it is owed significant back taxes. Some business owners are just taking the p### out of us with their selfish ways
