Bryan Rymer’s case adjourned again!
Appearing in the Magistrate’s court on December 5, 2011 for the continuation of trial, Magistrate Valerie Stephens adjourned the case to January 13, 2012 as there was no witness.
The Defense asked that the matter be treated as a priority one since the case was made since 2009 and that the defendant has always been present in court.
Mr. Rhymer shook his head in disgust as the adjournment date was being mulled over.
In June 2010, Smith had asked that the case be dismissed for want of Prosecution. She had noted that the next adjournment date would make the 11th adjournment since the case came to court in 2009. Smith had also said that a final adjournment date was already set and noted that only one of the adjournments was because of the defense, which was to accommodate a statement which they received late.
The defense attorney had objected to any further adjournment on account of the antiquity of the case, however, Magistrate Tamia Richards told Smith that she didn’t have all the facts or reason for the adjournments and therefore could not rush to the decision of dismissal. Richards had promised to examine the case provided that the attorney presents her with notes on the adjournments as well as examples of legal authorities.
The PI into the case began in the Magistrate’s Court in September 2010 .
Rhymer of Josiah’s Bay is charged with assault occasioning actual bodily harm, attempting to choke, suffocate or strangle, and wounding with intent. He had allegedly attacked a woman with a broken bottle and choked her at a 2009 Festival event.
In September 2010, attorney Duane Baptise who stood in place of the Defendant’s attorney Anthea Smith had told the Magistrate’s Court that the wheels of justice appeared to have been halted when it comes to the case of Rhymer; as the PI continued to be delayed. Baptiste’s comment was in light of earlier request made by Crown Counsel for the matter to be adjourned.
