ROAD TOWN, Tortola, VI- The Office of the Department of Public Prosecutions (DPP) has issued a statement in response to an article that appeared in a US publication raising concerns about the conditions of four US citizens held for illegal entry in the [British] Virgin Islands.

 Erroneous news article

“There is an erroneous news article titled: “Virginia woman worried about safety of sister detained in British Virgin Islands” by Scott Taylor, ABC7 WJLA, November 26, 2020,” the statement from the Office of the DPP on Sunday, November 29, 2020, read.

According to the article Lynn and John Hines claimed they, along with a friend and the boat captain, were sailing from St Thomas to St John when their boat entered 1.5 miles into the Virgin Islands water by accident. The article said it was after the captain of the boat turned back toward United States water that’s when the VI custom agents boat approached the sailboat.

“This is where they took our passports and all the boat's documentation and then stated that you are being charged with trying to enter the country illegally, not coming to a port of entry and they carry two $10,000 fines," says Lynn Hines, according to the article.

The Hines couple, from Manning, South Carolina, alleged Custom agents demanded they hand over $20,000 in fines before they are allowed to leave.

Additionally, Mr Hines said “We are hostages being held for ransom and not being charged. The only one charged is the boat owner. We have been informed because we were on the boat we were also in territorial waters and also being detained," says John Hines.

The Hines claimed their captain attempted to pay the $20,000 fine with credit cards but custom officials want cash.

"I am very concerned as I have seen the conditions of the accommodations they were given for their detainment. I don't understand why my sister and brother-in-law who were not charged are being held with no real resolution," adds Sue Carlin.

Detainees placed in mandatory quarantine

But, according to the Office of the DPP, the four persons were apprehended by the Joint Task Force, particularly Customs and Immigration Officers on November 19, 2020. 

It said Nicholas Cancro, John Hines Jr, Lynee Ann Hines and Jeanne McKinnon were on board a vessel that entered the Territorial waters without permission from the Ministry of Health and the Chief Immigration Officer, while the Territory’s Borders remain closed.

“The persons were charged with illegal entry without the permission of an Immigration Officer contrary to section 20(3) of the Immigration Ordinance Cap 130 as amended.

Pursuant to the Public Health  laws of the Territory that were introduced to protect the Territory's citizens from the spread of the novel COVID-19 virus,  the four individuals have been placed on mandatory quarantine for a period of 14 days at a local hotel.”

The Office of the DPP said all four persons are “safe and are being cared for with BVILOVE and with the finances of the Government and people of the Virgin Islands.”

The matter, according to the statement, was submitted to the Office of the Director of Public Prosecution on November 27, 2020, by the Commissioner of Customs at 11:15 a.m., following which the matter was processed and forwarded to the Magistrates' Court via the Police Prosecution Unit, for an urgent hearing date.

The Office of the DPP also reminded the public that the Territory reserves the right to apprehend and prosecute any person regardless of nationality, race, gender etc., who violates the laws of the Virgin Islands.  

“The allegations being circulated by the press and persons are without merit and can easily attract civil and criminal liability.

The Government of the Virgin Islands through its law enforcement officers remains committed to keeping the Territory safe. Additionally, the Territory looks forward to its reopening of its borders on December 1 when it will welcome visitors in a safe and controlled way,” the statement said.

One recently got 24 month ( deserve it, deported and should stay out). The Mexican Wall mean anything to you?

        Last time I sailed (admittedly a while back) I did not see any US Coast Guard ships just over 4,700 ft West of Treasure Point on Norman Island waiting to arrest errant day sailors who might make the mistake of going over the boundary....

    That’s right BVI, stick to your guns. All people who enter illegally will suffer the same consequences. The Captain should very well know better what the boundaries are in the water.     Anyone surprise by this claim. Some a American (not all) feel that the could do as they please in any country and not be held accountable. Check their news sites, these stories appear every day. Some news agency just like numbers (viewership) so they just put out some of them.

    The captain if he was experience in sailing these waters fully well know the boundaries. I suspect he did this before and got thru so try it again. Check some of these websites and you will see them advertising day trip to the BVI.

    There is absolutely no question that Customs and Immigration have the right to apprehend anyone entering BVI territorial waters without permission. Similarly once arrested, they have to be subject to the same quarantine regulations as anyone else....

    However, it would be interesting to know if their vessel was actually heading further into BVI waters or if it was heading out - as stated - towards St Thomas. If the latter case, do Customs and Immigration officials not have the flexibility of just warning them - and escorting them out of BVI waters? It would appear to be the most measured response in this instance.

    Of major concern, however, these people were apprehended on November 19th a THURSDAY. However, the matter was submitted to Director of Public Prosecutions on FRIDAY November 27th. That is EIGHT full days after the incident during which time the participants have been incarcerated. So the questions are:
    WHY WAS THIS NOT ADDRESSED IMMEDIATELY????
    WHO IS RESPONSIBLE FOR THE INEXCUSABLE DELAY?
    This does not reflect well on the territory... Yes we are fully within our rights to apprehend anyone, but the matter should be handled expeditiously rather than taking weeks. Quite possibly it should have been handled the day following the incident rather than committing BVILove resources to quarantine this group

      There is no need for the DPP to get involved as Customs have the authority to fine boats and do so up to $10,000 for each offence.

      The DPP only got involved due to the lies being published by the people from the vessel and informing them if they keep up with the lies and media attention they will be charged

        Since when does the DPP put out press releases on ongoing court cases. Seems like confidentially is out the door on this one. A brief statement from Customs (the arresting agent) would have seemed more appropriate.

    They break the laws they should be punished. They are white and American so they can enter any place anytime without no consequences. If it was a black person enters the US waters illegally we would see. The same thing with the fisherman case a few months ago. The mc millan case and west end in 1999 where the US media came to influence the proceedings just because it's a small place. Jail them with love.

    Escorting the boat out of BVI waters would have been the sensible and reasonable action to take. Supposing the people on board did have Covid, the BVI authorities would have been responsible for importing it into the territory. Conversely, had they had Covid, escorting them back to USVI waters would have resolved the matter there and then.
    And, as one commenter stated, the USVI could close the BVI yachting industry down overnight if the arrested every vessel that entered USVI waters in Drake Channel. Sooner or later this abuse will backfire.

    Illegal entries into the territory should be dealt with. The nationality of the individual should not be a matter of consideration. With the high risk of COVID-19, no one should be permitted to contravene the laws of the territory. This can lead to a massive outbreak of the virus.

I know a lot of like to think that it’s not deadly for God have spared us greatly in His Mercy but it is.. now to the story at hand - this is sheer propaganda that lady’s part re: her family being detained.. this gives us a very bad name in the press.. and to think that they are being quarantined and most likely fed 3 meals a day with our tax payers monies..she should talk that.. sadly the Law is the Law.. could they have been a bit lenient in the fees, I would say yes but the law has to be enforced regardless of whom it is , white, yellow, black or white- race “does not” and “should not” matter when it comes to enforcing the Law as long as they’re treated fairly.. I hope she retracts her statements for Gov’t could file a suit against her spreading misinformation.. trying to slander the BVI’s name with her lies.. this slander is nothing new for Caribbean islands when negative things happen with tourists - it’s a norm that needs to be nipped in the butt and quick to..

    It is impossible for them to be sailing from St. Thomas directly to St. John and accidentally wander 1.5 miles across the boundary. The distances between any parallel point on the St. John north coast and the corresponding BVI islands south coast (from Thatch up to Frenchman's Cay) are all less than 1.5 miles. Which means they deliberately sailed across BVI islands that they could see.

    I wish they would repeat those lies under oath.

      Actually, they were almost certainly tacking upwind, which, if you are a sailor, you will understand. If not, it means you are zig zagging back and forth across the direct course, in which you may very well be sailing almost to the shore on both sides. This doesn't mean that they were correct in doing this....far from it. But, if they were simply sailing as well as they could, they certainly would have crossed the line and almost come ashore.

If the persons said they were not charged and immigration told them they are not and now the DPP saying they are charged with an immigration charge, how is it Customs charging them a fine? And if they refuse to pay the Customs fine, shouldn't they have been taken before the courts and not thinking that they are not being charged and just hed for ransome. There is a statute of limitation for charges to be filed and proper notice to persons, was this done? Also, to the Immigration officials, if these persons are detained, why do they have access to their phones to use at their disposal? Certain things just ain't adding up.

    While they are in quarantine, they should read up and see what the US does with people who enter the US illegally. They will see that they are getting off well, if only a fine they are paying. In the US for this same charge you can be murdered or sent to Federal prison. Americans feel they own the world, that is what their problem is.

    I suspect they did not know they were in BVI waters. Why would the Customs demand cash? You can probably work that out. BVI customs has a bad reputation with US sailors and even with BVI sailors. They harass ordinary sailors and citizens and never for some reason catch any of the major drug dealers. More bad publicity for BVI in the USA.

    New leadership for Customs required as soon as possible.

One day you have the Governor of the USVI and The Premier of the BVI kissing on the cheeks, so to speak, - shaking hands sharing their joint history and family ties of loyalthy - yarda yarda yarda. Then a few American tourist out on a pleasure yacht - barley enough room between St John and Tortola to have a border and on the open seas - and this is how the BVI reacts

    BVI tourism is a major part of the economy. A hostile approach to a mistake by a day sailor may be justified by the letter of the law however lets see the bigger picture! Zero risk of covid from a boat that recognized the mistake and was headed back to US waters. If we want to enforce rules without any human thought, lets just replace people with robots. Otherwise- THINK!!!

    The BVI has never given proper notice of the suspension of the right of innocent passage. The UN is to be provided with the notice and has never done so.     USVI and VI are family. Priviledge Americans think they run the world and they are free to do what they want. Tourism economy or not they were not in US waters. Let's face the facts Privileged Americans travel all over the world and believe they have no boundaries. This will stop the next set when the borders are closed again. They knew exactly what they were doing and I have no sympathy for them.
