Woman guilty of ramming man with vehicle, & breaking his ankle

ROAD TOWN, Tortola, VI- A jury panel returned with a guilty verdict for Josiah’s Bay resident Isabella Merton after she allegedly rammed a man with her vehicle and broke his ankle.

The verdict was delivered shortly after 1:00pm at the High Court on Wednesday, March 4, 2020 before Justice Trevor Ward.

Merton was slapped with two charges from the May 20, 2018 incident: inflicting grievous bodily harm and reckless and negligent act.

The extent of her punishment will be made known on May 4, 2020 at the High Court in Road Town.

Allegations 

Court documents state that the Virtual Complainant (VC) was involved in a fight with Merton’s boyfriend on the day in question.

After the fight ended, the VC was walking in an area in Greenland, Tortola, when he saw a Jeep belonging to Merton driving towards him at a fast pace.

He tried to avoid the vehicle, but it hit him on the right side of his body, and he fell down.

The vehicle then turned and came at him again and to avoid further injury; he threw himself into the ghut.

While there, the VC allegedly looked up to see Merton pointing a gun at him and uttering the words: “If I’m disrespecting her man, it is she I am disrespecting and it’s kill she to kill me.”

Merton was then pulled away by another man.

An ambulance was called and the VC was transported to the hospital and treated for a malleolar fracture to his right ankle.

He spent about a month undergoing several surgeries for the broken ankle.

    A guy is a trouble maker. He wear a mask and attack her bf at the club with a knife but the bf had still disarm him and took the knife away. deserve it. Always picking problems with others.

    A car is a common mode of transportation for people and goods. Before a vehicle can be legally operated, a driver/applicant must be a minimum age, mentally stable, good health .........etc and must successfully complete a written examination on rules of the road and passed a road test before being issued a license to operate a vehicle. Operating a vehicle is a serious responsibility, for misused and abused it can become a lethal, deadly weapon like a gun, knife, machete..........etc. The accused in this case has had her day in court with the opportunity to present any mitigating circumstances and has been found guilty by a jury of her peers and will be sentenced appropriately by a learned jurist. The BVI is a civilized democratic society that has the rule of law as its twin. Justice must be blind and administered fairly and equitably regardless of gender. Let lady justice reign. Driving is a privilege, not a right, and whatever sentence is handed down this accused should have her license suspended for a lengthy period, under go some mandated counseling and perform at least 100 hours of community service on the proper use of a motor vehicle.
