VC testifies again after alleged Banco Popular assault
Power, 30, pleaded not guilty to the offences of unlawful and malicious wounding and criminal damage and is being represented by attorney at law, Stephen Daniels. He was previously represented by another attorney but requested a change in representation after appearing before the court at an earlier hearing.
Senior Crown Counsel Sarah Benjamin told the court that the Virtual Complainant in the matter was unable to tender a damaged pair of antique spectacles into evidence when he was first brought to the stand therefore, the Crown, reserved its right to recall the VC to do so.
At least one other witness is expected to take the stand on behalf of the prosecution, according to Benjamin.
According to the allegations, on October 5, 2011 at about 2:30 P.M, the Complainant was a customer in a queue at the drive-thru teller at Banco Popular in Road Town. The Defendant, Simeon Power, was not in the queue; however, he allegedly drove his blue Mistusbishi vehicle from the back of the line and cut in ahead of the Complainant, Michael Helm.
The Complainant, who is an elderly gentleman, went and knocked on the Defendant’s car window, in a bid to talk to him about what he had done. The Defendant allegedly exited his vehicle, cursing, and pushed the Complainant, causing him to fall and hit his head on the pavement. This, according to the court, resulted in a wound to his forehead. The Complainant was also wearing an antique brown framed, multi invariable lens glasses, which allegedly got damaged when he fell to the ground.
The Defendant was allegedly pointed out at the scene by witnesses and arrested. The defendant was formally charged with the offences on October 6, 2011 .
