UPDATE: Hart & VC allegedly had misunderstanding while at HM Prison
-Stabbing victim denies he owed alleged attacker money
The trial proper of Matthew Hart finally got started in the High Court today May 15, 2013 before Justice Kelvin John and saw the Virtual Complainant taking the stand.
The case was initially scheduled to commence on Monday May 13, 2013 when Hart was pleaded but was subsequently put off for two days to allowing the legal personnel concerned to deal with issues of the law before proceeding with the trial.
Hart is being tried for allegedly inflicting grievous bodily harm on Ivan L. Govia on July 27, 2012 while at the Festival Grounds in Tortola.
The incident allegedly occurred on the night of the virtual complainant's birthday. In giving testimony, Mr Govia told the court that on the night in question he was approached by the accused, Matthew Hart, who had requested $5 of him. He said he had asked the accused if he wanted something to eat but he insisted he need the cash which was denied by Govia.
According to Govia, Hart had seemed "hyped" that night as if he was under the influence of Marijuana.
Govia alleged that shortly after his interaction with the accused he felt a sharp object to the right side of his back, turned around and noticed Hart with what he believed to be a jagged edged knife before passing out and being taken to hospital.
The VC told the court that he had known Hart and that they had shared a cell at Her Majesty's Prison where he (Govia) was being held for possession of Marijuana.
During his testimony, Govia denied owing Hart any money, using threatening language against him, trying to take off the defendants pants while at the festival ground and having any physical altercation while they were prisoners at Her Majesty's Prison. He, however, did admit that they had an argument while in prison and that it ended with Hart leaving the cell.
Appearing for the crown was Tiffany Scatliffe and Leslie Ann Faulkner while Charmaine R. Rosan-Bunbury appeared for the defendant.
The crown has indicated its intentions of calling two other witnesses to give testimony- A police constable, who was the arresting officer on the night in question, and the investigating officer.
