UPDATE - Kelbert George: I was fearful for my life & played dead!

ROAD TOWN, Tortola, VI – The Virtual Complainant in the VG assault trial that is taking place in the High Court this week, claimed that during the attack on him on June 26, 2010, he was fearful for his life and played dead.

The alleged perpetrators on trial for the alleged attack Sherwin Fahie and Rasheda Hodge, have pleaded not guilty to unlawful and malicious wounding with intent to cause grievous bodily harm.

Kelbert George Jr. was the Crown’s key witness and took the stand late yesterday afternoon Wednesday February 29, 2012 and recalled the harrowing experience.

During his testimony, George Jr. who is known as “Zekkie”, stated that he was jumped by some guys after coming out of his car outside of his house at around 3:30 a.m. on June 26, 2010.

He told the court that during the night of June 25, 2010, prior to the incident, he went to Mine Shaft where there was a birthday party but did not go inside as he listened to music for five minutes in his car then left the area to look for his friend Tristan Nisbett. George said he drove to Nisbett’s home but he was not there so he turned around and left.

The Virgin Gorda resident went on to tell the court that while he was driving a black jeep was following him. However, he said he could not say much about the jeep because it was not very close to him at the time.

He said during his journey home, the jeep “would turn into a corner and stop and then it will suddenly reappear” and that there was no other vehicle on the road at the time.

“As I reached home, I turned into my gap this was across the road and as I stopped my car a black jeep pulled up near me. I looked at my side mirrors and was trying to figure out who this vehicle belong to. I put my car in parked and the jeep suddenly turned off,” the VC remembered.

He said he then got out of his car, locked it and was about to cross the road when he realised the jeep had turned around and was coming back in his direction.

“The jeep pulled up in front of me and I stopped. While the jeep stopped the front passenger door opened and a guy came out in a rush with something appeared to be a gun in his hand. He came up to me and hold the left side of my collar. I tried to alert the neighbourhood and so I shouted mommy, mommy,” the young man testified.

George Jnr, claimed the person who held him then said, “Mommy, mommy” and hit him with the object in his head extremely hard. He recalled falling to the ground unconscious.

“After that I started to regain consciousness and I tried to get up back to my feet.”

According to George, he was able to get to his feet and another individual came out from the back of the jeep.

“The individual came out and he said, ‘me ain’t got your mudda s.... (expletives) now, me aint got your mudda s…. (expletives) now’,” the VC said were the words of the second individual who had joined the first one, and claimed he then received a blow to the back of his head, which plunged him to the ground.

“After that I got back up once again and once I was up the guy hold me by my collar and he pressed the object against my temple very, very hard. While pressing the object against my temple, at the left side of my head he was saying something got to done. I didn’t recall clearly what he was saying and I replied by saying it done, it done. He also said, any time he has to hear anything again and he come back to Virgin Gorda he is going to kill me and all of my man them,” he further testified.

At that point, George said his head was tilted to the side and he realised it was actually a gun in the individual’s hand and it was at that point that he “played dead”.

“I was fearful for my life so I played dead … I played like I fainted, I dropped out of his hand falling to my face,” he told the court.

Senior Crown Counsel (ag) Sarah Benjamin then asked George if he was able to observe the person at that point, to which he replied that it was a man with his “hair plait” who he had seen earlier that night of June 25, 2010 at Delta Gas Station around 10 p.m.

George said he had gone to the gas station driving his friend (Tristan Nisbett) aunt’s jeep and his friend was driving his own jeep to full up fuel. He recalled seeing a group of individuals, who he identified at the right side of the building and one was sitting in a chair. However, he said the one that was sitting in the chair he had never seen before in his life.

During the beginning of the trial earlier yesterday February 29, 2012, Senior Crown Counsel (ag) Benjamin had stated that the couple alleged malicious attack on George on Jun3 26, 2010 was carried out as an act out of revenge.

According to the Crown, Fahie, Ms. Hodge and a third person were allegedly present when George was brutally attacked.

Ms. Hodge was the alleged driver, while the other two allegedly kicked and struck the VC several times that resulted in injuries to his head.

The senseless and unprovoked act Crown Counsel Benjamin explained to jurors, allegedly stemmed from an altercation seven months prior to the assault between Nisbett and an individual.

“Nisbett is the best friend of George and the altercation did not go in favour of X [the individual]…and because of this a plan was hatched to attack George,” Benjamin told the court.

“It [the attack] left George fearful for his life…he had no beef with these individuals.”

Nine witnesses will take the stand for the Crown’s case, which is expected to wrap up by Friday.

The accusers are being represented by Mary Lou Creque and the VC will continue his testimony this morning at 9 a.m. March 1, 2012.
