Unapproved activities on VI beaches will be shut down– Hon Turnbull warns

- says blatant violation of beach policy continues on Cane Garden Bay, Long Bay & Beef Island beaches

ROAD TOWN, Tortola, VI– Minister for Natural Resources and Labour, Hon Melvin M. Turbull (R2) has warned against unauthorised use of beaches for commercial and non-commercial activities, which he says continues on beaches at Cane Garden Bay, Long Bay and Beef Island.

During a statement at the Second Sitting of the Fifth Session of the Fourth House of Assembly at Save the Seed Energy Centre in Duff's Bottom on January 26, 2023, Hon Turnbull reminded that the Ministry has had a long-standing practice of requiring permission for all commercial uses and certain non-commercial uses of the beach.

Policy formalized in 2020 - Hon Turnbull 

“That practice was formalized as policy in 2020 with Cabinet’s approval of The Virgin Islands Beach Policy, which is available on the Ministry’s website,” he said.

Hon Turnbull added that the local Beach Policy requires that persons apply to the Ministry of Natural Resources and Labour for permission to use beaches for any commercial activity, regardless of the size of the operation, presence or absence of a structure, type of structure, or whether it is a temporary or permanent operation. 

“This applies to all bar or restaurant operations, snack vending, souvenir or craft vending, beach chair rental, water sport operations, other nature-based activities, hair braiding services, spa/massage services, or any other activity involving the sale of goods or services at the beach,” he said.

He said the Policy also requires the Ministry’s approval of non-commercial activities in cases where there would be groups larger than 50 persons, loudspeakers, or open fires. Madam Speaker, this may include, for example, large or loud private parties or barbeques, public entertainment events, sporting events, family reunions, camping, church events, corporate events, cultural events, and so on.

“Madam Speaker, the Ministry is aware that many persons and organisations are carrying out commercial activities and non-commercial events on beaches without the required permission. In carrying out these activities, in addition to violating the Beach Policy, in many instances, persons are building structures on the beach illegally and even squatting on Crown land. Persons are also operating without basic legal requirements like a trade licence, liquor licence, and food handler’s licence,” he added.

Hon Turnbull related that, in addition to requiring permission for use as outlined above, the Beach Policy sets out parameters within which persons must operate to ensure the protection of the beach and the enjoyment of all users. For example, the Policy states that no equipment or beach chairs should remain on the sandy area of the beach unless they are in use.

“Madam Speaker, one reason for my intervention today is to again make the public aware of the requirements to apply for permission to use beaches for any commercial activity as well as non-commercial uses in cases where there would be groups larger than 50 persons, loudspeakers or open fires, and to remind persons of other requirements around beach use, set out in the Beach Policy." 

He said for persons violating policies, the Ministry will work to collaborate with the Royal Virgin Islands Police Force, the Town and Country Planning Department, Trade Department, the Attorney General’s Chambers, and other relevant authorities to uphold the Beach Policy and enforce all applicable legislation, which means unapproved events and commercial activities on VI’s beaches will be shut down.

      If you want to keep our beaches nice and clean, how about ticketing the people who bring their dogs regularly to the beaches, letting them crap all over, and never picking up after them? How can we enjoy our beaches if we have to look everywhere we walk or sit down without dog sh-t everywhere? That is also a crime that the police will not address, even though it is the law.

      The beaches have been made very comfortable with tents and chairs. No one can sit out in the sun all day or risk getting sunstroke. Why are you troubling tourist and local comfort? Building structures are an entirely different story.

    Inappropriate activies on all public beaches in the BVI should have already been hindered more the 25 years or more ago, more so at Cane Garden Bay, Tortola BVI.
    Come on Hon. Minister Mitch Turnbull, stop pretending that you are blind to these happenings.
    Cane Garden Beach is a village beach. For sake of th "Yankee's dollars, we have, as a Country, already sold our soul to the devils for material gains

    In addition to the above, your Father, Dr. Melvin Turnbull is the founder, if not mistaken, of the Cane Garden Bay Baptist Church, aproximately one and fifty feet from the beach. You were brought up in that church, and probably a member, I believe.

    Some of the activites that you have mentioned are not as Spiritually lawless as the customary inappropriate unetical behaviours the have, and ars continuing at Cane Garden Bay Beach. Of course law and order need to be enforced on all our Public beaches, but of all the public beaches in the BVI, inappropriate unethical behaviours have, and probably continuing at your home village, Cane Garden Beach. That do not mean that yiu are wrong to speak out against elegal, and unapproved activities. You should, but first begin by addressing unethical, and second unapproved lawless activities.
    Of the two, Cane Garden Bay wears the crown.

    I am not trying to hurt your feeling, Hon. Mitch Turnbull, but I am trying to help you get your priorities in order.

    and asked us to elect them as defenders of your and mine best interest, We did. but as soon as the have have pledged allegence to the UK's Queen, now deceased, they are treating you and I as, if we have have given them our position as our employers, and we their employees.

    Chairs at cane garden take up a tremendous amount of beach area. I have to walk way around therm and cannot just take a leisurely walk for exercise anymore. I doubt anything will be done though. They are a permanent fixture set out for cruise ship tourists.

    The beaches in the BVI and the USVI are public. No business nor individual cannot and should not be able to operate any business for personal gains without the proper permits. The taxes generate help the Government maintain these beaches for PUBLIC use

      Where were you when i saving all dem people from drowning for 14 years, where were you when somebody got an emergency for a restroom,where were when families been fed when i only take cash and they got plastic,where were you with first aid medical stuff for damaged patrons,where were you to pay an escavator and 2 bush cleaner out my pocket for weeks after hurricane irma destruction.     Go on now Mitch. Get those illegal vendors out of there. Ruining the ambiance. Illegal! Before trade licenses are given to vendors they need to prove the have permission from the owners of the property to be there. They should have a lease. You got a full out restaurant under a tent / no roof / acting as a permanent operation and is a 'vender' in CGB taking up half the beach with chairs year round. Get him out! Do your job! He is a public nuisance. And you know it. Do you job minister.

    We are all there to make a dollar to pay your bills and provide for your families and this how we all want to talk bad about each other? What a shame! We all are going to die one day and leave the same place and land we all talking about. Have you seen anyone die and that anything with them? No.. let us all start to think about our souls and pray and ask God to help us to live with each how he would want us to. All of us going to die and leave the chairs, tents, building, rum, money, land and everything else same place to rot. So why try to fight each other over them? Live and let others live. Let’s try and change hi we think.. I will start with myself.. Lord help me to change whatever needs changing in me first and help me to helps others to change too.
