Throne Speech: Magistracy to go digital with E-summons & new Rules
According to Governor Pruce, there are plans to implement Criminal Procedure Rules akin to the existing Civil Procedure Rules, and explained that they would "serve a vital role in managing all criminal matters filed with the Supreme Court."
The introduction of these rules, he said, will streamline case management by setting clear filing deadlines, disclosure requirements, procedures for adjournments and bail, and the electronic service of documents.
“The Magistrate’s Code of Procedure Amendment Act will authorise the Cabinet to make rules for the just and expeditious management and dissolution of all criminal cases in the Magistrate’s Court,” Governor Pruce stated, adding that the adjustments will allow the local magistracy to adopt these rules while accommodating its operational framework.
E-Summons
Another of the proposed reforms identified by the Governor, involves allowing summonses to be served electronically or by mail—a measure he described as having "significant benefits in terms of efficiency, accessibility, and compliance."
With this in mind, he sought to emphasise to members that the modern delivery methods will not only reduce administrative costs associated with manual processes like printing and in-person delivery but will also "ensure clear and verifiable histories of communication through standardised record-keeping."
The legislative agenda for this session, according to Governor Pruce, also includes introducing provisions for Restorative Justice, a concept he praised as a transformative addition to the justice system.
“Restorative justice legislation formalises processes that focus on repairing harm caused by criminal behaviour as an alternative to the traditional punitive justice system,” he said; The proposed Act will aim to foster accountability, reconciliation, and healing among victims, offenders, and the wider community.
Further, the Act will establish an Advisory Council on Restorative Justice to oversee the integration of these principles into the justice system.
“This is an opportunity to prioritise healing and accountability while engaging all stakeholders in the justice process,” Governor Pruce said.
