ROAD TOWN, Tortola, VI- The old maxim ‘Justice delayed is justice denied’, which means that if legal redress or equitable relief is available, but is not forthcoming in a timely fashion, it is effectively the same as having no remedy at all, may very well apply to the state of judicial affairs in the Virgin Islands (VI).

According to the Report on the Deliberations of the Standing Finance Committee (SFC) to Examine the Draft Estimates for the Year 2023, there is a concern with the growing number of persons on remand and awaiting trial at Her Majesty’s Prison (HMP) in Balsam Ghut.

Some inmates on remand for 5 years- Hill

This concern was made by Superintendent of Prisons Mr Guy M. Hill who told the SFC in December that there are a number of persons on remand and that the Prison is part of the Virgin Islands community.

Leader of the Opposition and Member for the Third District, Hon Julian Fraser RA had asked what is the Superintendent’s role with regard to a speedy trial for persons detained at the Prison that are not sentenced.

According to the SFC Report, the Superintendent stated that his role is limited because there have been inmates who have been awaiting trial for up to five years and questions were asked to the DPP and Attorney General’s Chambers.

Persons on remand & awaiting trial ‘increasing’

While no figures were given in the report, Mr Hill further stated that there are a number of persons who are remanded and awaiting trial and this has been increasing ever since the post was being managed at the Prison.

The Superintendent stated that there is a “big concern” as to how long inmates are remanded.

“If someone has been remanded for two years awaiting trial, then that should be looked into,” the SFC Report stated.

Hon Fraser then mentioned that something needs to be done regarding the inmates who are remanded for an extended period.

Legislation may be needed?

The Minister for Health and Social Development and Member for the Eighth District, Hon Marlon A. Penn, stated that “in terms of the length of time a person is on remand at the Prison adjustments might need to be made to the Legislations to address the matter.”

The Prison population is constantly around 113 – 115 for the last year, according to the SFC Report.

HMP is able to house 140 prisoners; however, staff shortage remains an issue.

It was also noted that a total of 28 inmates were released on early release on a recommendation to the Governor.

    On another note, check and all will see that in the last 10yrs there were two UK persons that ran the prison. They ran it into the ground, and it has gone silent. Just stating for the record for those who always chatting foolishness that the UK needs to take over as if they are perfect human beings.

      Go ahead it is the "inthing" to blame the UK, the Governor and the Police for everything that goes wrong in this country.

    Ridiculous.
    Is the DPP is afraid to take these matters to trial because she will lose?- does she think it is better to make them serve prison time before they are acquitted?

    This SUP is full of it! Simple matters up at prison he cannot handle, he come to the SFC with out any evidence, just a bunch of hot air. Fraser was right to question his role and how he can assist with the process, simple tasks such as ensuring prisoners are ready for court appointments or keeping those out of other prison officers to at least act competent in their roles!

    Hell, 5 years? Let them out for time already served. This is the worst prison time without a trial. Is this even legal? What if the prisoners were only getting 2 or 3 years? Does the government now owe them money for the loss of wages that could have been earned? The person responsible for this should be put in prison and see how they like it!

    On remand for 5 years without trial is unjust and cruel an unusual punishment. It is a sentence without one having one’s day in court. Would it be fair if one serves this lengthy time on remand and is found innocent at trial.? How do you make the person whole? One is entitled to a speedy trial? Does anything in the VI work effectively?

    I knew someone that was on demand for 3 plus year for an offense that carries a maximum of 1 year in prison. And he's say up to 5 years on demand when there is people in there for long than 5 year without going to court. Also I heard they have this AVCL audio video court link which is a joke. That should only be used for bail hearings cause if someone need to speak with there lawyer how will that happen it unjust and a clear violation of ones rights
