Sex refusal escalates into alleged assault & pillow smothering
CHRIATIANSTED, St. Croix - In a startling turn of events, a man who initially claimed to be a victim of an attempted smothering by the mother of his children was arrested for the offense.
According to court documents, Earl Shervington called 911 shortly before 3:00 a.m. last Friday, requesting police assistance regarding an altercation with his children's mother. However, upon the arrival of the officers at the scene, Shervington stated he no longer required their help.
The situation took a twist when officers met with the woman in question. She alleged that it was Shervington who had tried to smother her with a pillow while she was in bed. According to court documents, the police observed bruising and injuries on her lips and inner mouth area, leading to Shervington's detention and questioning at the Ancilmo Marshall Command police station.
In his statement to the police, Shervington explained that he attended a neighborhood party last week with the mother of his children and their four kids. At the party, a woman asked him for a drink. As he was getting her the drink, he noticed she was using her cell phone. This led his children's mother to mistakenly believe that he and the woman were exchanging phone numbers, which sparked a verbal argument between them.
Shervington explained that after leaving the party, he and his family went to the house of his children's mother. There, he entered the bedroom to put their youngest child to bed and accidentally fell asleep alongside the child. He was suddenly awakened by a pillow being pressed over his face. Shervington recognized that it was his children's mother who had done this, and he managed to push her away after a few seconds. The commotion woke their one-year-old, and the child's mother then prepared a bottle for the baby before leaving her house. It was at this point that Shervington called 911.
Regarding physical injuries, Shervington had a broken nail on his right pinky finger, which he claimed occurred during the scuffle with his children's mother. However, the police did not find any other signs of injury or bruising on his body. They also noted that the incident took place at the residence of his children's mother, and that Shervington lived at a different location.
After interviewing Shervington, police officers visited the residence where the alleged incident occurred and spoke with the woman he accused of attempting to smother him. Contrary to Shervington's account, the woman claimed that she was the one who had put the child to bed and fallen asleep next to the baby. According to her, she was awakened not by a pillow over her face, but by Shervington removing her underwear and propositioning her for sex.
She told the officers that after she refused his advances, an argument broke out. During this altercation, she said, Shervington overpowered her, held her down on the bed, and smothered her face with a pillow. The woman described struggling to breathe as Shervington pressed the pillow against her face, blocking her airways.
This ordeal, she said, lasted for about 30 seconds and only ended when their one-year-old child started crying. Fearing for her life, she stated that Shervington attempted to smother her a second time, but she managed to fend him off. Afterward, she prepared a bottle for the child and left the home, only to return later and find police present.
Officers observed bruising on the woman's lips and noted that the pillow allegedly used in the assault had blood stains near the center. Subsequently, Shervington was arrested and charged with second and third-degree assault, the latter categorized as an act of domestic violence.
He was brought before Magistrate Ernest Morris on Monday. While the full details of his advice of rights hearing were not disclosed, court records show that a $1500 bond was posted by Shervington, indicating that he may have been granted pre-trial release.
