RVIPF investigating video calling for violence
In a public statement from the RVIPF today, Wednesday, December 18, 2024, Detective Chief Inspector (DCI) Kenrick Davis stated that the contents of the video may involve material that crosses the threshold for serious criminal offenses.
While everyone has the constitutional right to freedom of expression, he emphasised that it does not permit individuals to express anything without considering the potential consequences for others in society.
Intentional incitement carries prison time
Section 351 of the Criminal Code, Revised Edition 2013, establishes the offense of Intentional Incitement, carrying a maximum penalty of ten (10) years in prison.
Section 19 of the Counterterrorism Act of 2021 addresses actions that intentionally incite others to commit terrorist acts. The Act also defines what constitutes a "terrorist act," and it appears that the statements in the viral video fall within this definition. The penalties under this Act are more severe than those under the Criminal Code, with a maximum penalty of fourteen (14) years in prison and fines of up to $500,000.00 for intentional incitement, the release goes on to state.
Refrain from inciting violence
Additionally, DCI Davis noted that Section 14 of the Computer Misuse and Cybercrimes Act provides for criminal charges for material deemed "grossly offensive" or containing a "menacing character."
The RVIPF stated it will update the public as the investigation progresses.
The public has therefore been advised to refrain from inciting violence in any form and to choose methods of expression that do not endanger the safety and well-being of others.
It is believed that the video was produced by Kareem K. Pickering aka 'Picko Moff' and posted to his Facebook page last week, however our News Centre cannot confirm that this video is the target of the RVIPF's investigation.

He said to remember three things in this arguement:
1. Strict Scrutiny:
He said Laws that restrict speech based on its content are usually considered content-based and face strict scrutiny by courts, meaning the government must demonstrate a compelling reason to restrict the speech and that the restriction is the least restrictive means to achieve that goal.
2. Exceptions to Protection:
He emphasised that while content is generally protected, certain types of speech are not, including speech that incites imminent lawless action, defamation, child pornography, and true threats.

3. Time, Place and Manner of Restriction:
He mentioned that in a Democracy, Governments can regulate the time, place, and manner of speech, even if it restricts certain content, as long as the restrictions are not based on the viewpoint being expressed.
