Premier fails to get UK Minister to lift Order in Council

- Lord Goldsmith said UK wants to see reforms implemented before Order in Council can be lifted

ROAD TOWN, Tortola, VI– Despite pushing the narrative of a ‘Modern Partnership’ between the United Kingdom and the Government of the Virgin Islands (VI), UK Minister for the Overseas Territories Lord Frank Zacharias Robin Goldsmith has indicated that the controversial Order in Council to suspend the VI’s constitution will not be lifted until the Commission of Inquiry (CoI) reforms are completed.

The Minister, in a statement released by Government Information Services (GIS) today, February 3, 2023, claimed that, coming out of meetings and discussions over the last few days in the VI, there is a desire for a stronger modern partnership between the Virgin Islands and the United Kingdom (UK) and that it includes safety and security of the territory.

Room for stronger partnership - Lord Goldsmith 

“It also applies in other areas like health, education, energy reform, where there's room for much stronger and better partnership, sharing best practice, technical expertise, encouraging investment into this territory.”

He further announced that the UK has funded 4 new rigid inflatable boats for the police, which will provide a boost to the capability of the local marine police.

Lord Goldsmith said the second thing that stuck out for him was the strength of the commitment he heard from the Premier and his Cabinet to promoting good governance and carrying out the reforms in line with the Commission of Inquiry.

The Minister said; however, he was aware of the Premier’s feelings surrounding the Order in Council and that of the people.

"We too want to see these reforms seen through, such that the Order can be lifted."

Lord Goldsmith said he will continue to support the [British] Virgin Islands, both in the next few months and after the general election, in taking these reforms forward "so that we can realise the Premier's vision of the BVI as a beacon of democracy.”

Remove Order - Premier Wheatley 

Premier Wheatley, as well as regional and international bodies, have called on the UK to remove the Order, but despite this, the UK Government has not budged on the request.

Dr Wheatley, who has been slammed for keeping Lord Goldsmith's arrival and itinerary in the VI a secret, had also said Lord Goldsmith was open to discussions about the Order in Council and it would be up for discussion during his VI visit.

The Order in Council in reserve has been likened by many to the UK holding a gun to VI’s head, which they argue is not representative of a modern partnership, but reeks of colonialism and even racism.

In a statement to Members of the 77th Session of the UN General Assembly: Fourth Committee (Special Political and Decolonisation) in New York City on October 6, 2022, Special Envoy of the Premier Mr E. Benito Wheatley said the reserved Order in Council is a form of pressure that can weaken democratic governance and hinder a genuine working relationship between the VI and UK.

Mr Wheatley also told the UN there should also be sensitivity about the feelings of the Commonwealth Caribbean on this issue in terms of the colonial past.

Both CARICOM and the Organisation of Eastern Caribbean States (OECS) have also condemned the threat of direct rule by the United Kingdom on the Virgin Islands.

“A new modern partnership can be established if both sides act in good faith,” Mr Wheatley argued.

Other Order in Council

In the spirit of ‘modern partnership,’ the UK is also forcing the VI to implement a Public Register of Beneficial Owners b the end of 2023, even when it is not a global standard and even though the European Union (EU) Supreme Court recently rejected it.

The European Union Court of Justice on November 22, 2022, struck down the European Union (EU) mandate for public registers of beneficial ownership of all companies.

The Justices ruled that the provision whereby the information on the beneficial ownership of companies incorporated within the territory of member states is accessible in all cases to any member of the general public is invalid.

The court ruled that registers containing the personal details of the owners of a company and accessible to the general public are an infringement of fundamental rights of privacy and personal data protection.

The [British] Virgin Islands has said it has no issues with making beneficial ownership registers public once it becomes a global standard.

    Stop letting the UK make us blame each other. Yes, I agree improvements are needed but the BVI is no worse than anywhere else in the world. The UK created a well organized agenda but with time they will realize the people of the BVI are a resilient people. We shall overcome.

    An election will not change the intent of the Governor and his senior public servants in the UK who are his bosses and who advise the UK Minister because they have no regard for us, never did and never will. This is what the Order in Council is really about, instructing behind the scenes to have laws like the police act and others passed so that when they pass them and our rights are abused then the UK can say we did it to ourselves when in fact they forced the actions from behind the scenes with things such as the Order in Council which came from the well organized pre-arranged COI and recommendations. The only thing can begin to stop this no matter who is elected is an uprising of the people.

      Are you really serious. The previous head of government is under arrest in Miami for drugs and money laundering. The head of the BVI Ports is in jail for the same crime along with her son. The head of BVI Customs has been removed and the heads of the Post Office have been charged for a crime. If you were the UK would you trust the government of these islands, truthfully

    People of the BVI do not be fooled or brainwashes. Racism is trying to be down played but it is a factor with all that is going on with our country especially with the actions of the UK. The white police officer and their head do not trust the black police officers nor do they trust the other law enforcement agencies who are predominantly black. They want to discredit them and is being done through abuse of their powers to try to justify their colonial actions but camouflage it as good governance. Let us wake up and be aware and stand up for what it right. Ask yourself when last you saw or heard anyone other than black locals and black Caribbean people been audited, investigated, or arrested.       Only 15 percent can vote? According to the most recently updated voting list, there are almost 14 thousand registered voters across the nine districts without including the valley virgin gorda. for your 15 per cent estimate to be correct, the population would have to be about 70 thousand. and we all know the population is around 30 thousand or so. so check your facts WEW.

    It is clear that racism is an issue that the UK is trying to cover up. Ask yourself how many black UK Governors are there in 2023? Ask yourself how many black UK staff is in the Governor's office and Commissioner of Police especially in recent times? Ask yourself how many black people are on staff especially in senior post in the UK Foreign Office that is over the BVI and other Caribbean Overseas Territories? The answer to all of these in 2023 is ZERO. People do not let them get away hiding their true self as this continues to be the crux of the matter although being marketed otherwise. They see the Caribbean people as no good and inferior to them. This is the real issue.

      B.S about COI was pre arranged. I will correct all of you, the COI was properly pre-investigated before calling the witnesses who are now suspects. We in the UK don't need BVi and yes we have out own mess to sort out. But look at it, the corrupt ones are there, but they are removed from office. As a BVIslander in the UK, I am never profiled as black in a white society. I got benefits before landing a job and my children are properly educated. My physically disable child is taken care of here. In the BVI is where I got the most hell from my own people. The system in UK is not perfect but it sure can be implemented the bvi to make life better for many.

    This is not surprising news, for FZR Goldsmith does not have the power to singlehandedly lift the order in Council. FZR is part of the UK’s government team and part of the collective responsibility team, ie, supports approved government action. FZR supports the UK’s position, not the BVI desires. It was fools gold to expect that he would lift the OIC. Good Colbert try though. Hear is a news flash the UK has the unilateral and has had if it for centuries. What Virgin Islanders need to do is to unite for a common and purposeful self-determination gold.

    We have been brainwashed by a perfect storm by the UK. The first course of action in any take over is bring division among those who you want to take over. Then make them doubt each other and blame each other. Then make them feel like they can do nothing correct. Then make them not trust each other and any of their leaders. Then make them ask for outside intervention. The UK has mastered all of the above but with time they will fail.

    There was no transparency in how the Governor selected the Commissioner of the COI. There was no tender process. No one knows how much he was paid and what was he given as the job description that caused him to take the job. If a local politician did something like this and then get a report from this action and acted on the recommendations we would have been hitting the roof condemning them. We should not be allow this double standard.

      I do not see anyone blaming the Governor in full. What they are saying is let the system deal with the issues and not a one man. Let the judiciary system, public service commission, the policies etc. No one individual or entity should be the law of the land. That is dictatorship. Also no one gets to see what is wrong on their end.

    We are always looking for an amicable solution to our UK problems. If our agenda is different from the UK's agenda for us how can we find an amicable solution? The UK wants us to forever be their colony and the only way out of that is to separate from them. That's why they gave us a Constitution where they have the ultimate power and they have to assent to our laws. We know and see it yet we pretend to have partnerships and the power to negotiate and other things that make no practical sense. It's better to struggle on our own until we get it right than to be a UK colony.

    Lord Goldsmith. They thought if they smiled, wined and dined, kept your movements restricted, and only toom you to Anegada you would bend to their will. Anegada was a great choice. But you also made the right choice. If they feel too free they will not work in the best interest of the people in this territory; only for a select few. Let's see how this plays out. So many important serious things to deal with and you turn EVERYTHING into a chance to push your simple-minded story, promote hate in the community and push an independence agenda that no one has ever outlined a positive vision for us to consider.     The Premier should have been focusing on getting the recommendations completed first before trying the get the order in council lifted. He gave his word to implement them, and became premier as a result. Did his word mean anything?

    He has only suceeded in painting the BVI in a darker shade of grey. The BVI is now definitely seen as incapable and corrupt. God help us all.
