Local who called policewoman a ‘fat bitch’ fined nearly $4K for traffic offences

ROAD TOWN, Tortola, VI- Long Trench resident Irvin Anthony Smith, who reportedly called a female auxiliary officer a ‘fat bitch’ and hurled other indecent slurs at her, was fined nearly $4,000 when he appeared virtually before the Magistrate’s Court on Monday, September 7, 2020.

More about the matter

The offences occurred on December 13, 2017, months after Hurricane Irma smashed the Territory.

The officer in question, Tishema Smith, who testified before the court on Wednesday, October 2, 2019, said she was conducting a routine traffic stop when she noticed the defendant’s jeep with an invalid registration sticker.

After signalling him to stop, the accused reportedly told her “Ayo doh just see what happened?” referring to the recent passage of Hurricanes Irma and Maria.

“Ayo just full of f***. It don't have a grace period?” the defendant reportedly said.

He also allegedly called her a ‘stinking fat bitch’ and asked her to return his driver’s license and continued to be disrespectful despite warnings for him to stop.

The accused was subsequently placed under arrest, and that’s when things got ‘messy’.

The officer said when her male colleague told the defendant that he was being arrested, he allegedly resisted.

He reportedly questioned the reason for his arrest and said, “Who arresting me? You? You gonna need help.”

Smith said the defendant had pinned her colleague to the ground, and that was when she used pepper spray to subdue him.

Smith testified that during the altercation, her colleague officer struck the defendant on his leg and forehead, which inflicted a wound.

Following the scuffle, the defendant reportedly cried out to onlookers that he was being brutalised by the law enforcement officers.

Mitigation

Attorney Carmelita Jameison, who represented the accused during the proceedings, implored the court to tender justice with mercy and if fines were to be implemented, let them not be the maximum.

She disclosed that the small scale farmer was the main provider for his family, and with the Coronavirus, it was challenging for him.

She also pointed out that he had no previous run-ins with the law.

Fines

Magistrate Ayanna O. Baptiste-DaBreo fined Smith $2,000 for criminal damage. He is facing four months at Her Majesty’s Prison if he does not pay.

He was fined $500 for the offence of indecent language, and he is facing up to 30 days in prison if he does not pay.

For resisting arrest, a fine of $500 was given to him or in default he would spend 30 days in prison for failure to pay the fine.

He also had traffic offences.

Smith was fined $500 for driving an uninsured vehicle, and this carries a 30-day term of imprisonment if he does not pay.

The final fine, of $100, was slapped on him for driving an unlicensed vehicle. He is facing four days imprisonment for non-payment.

Smith pleaded guilty to the traffic offences, but not guilty to the criminal offences, which went to a trial, and he was later found guilty by the court.

He is expected to reappear before the court on January 14, 2021, for reporting purposes.

    December was too early to be calling in car checks after Irma! That is the government's fault. That said, if this guy had had a bit more respect I suspect she would have let him go with a warning. Typical Tola attitude. Assaulting female police and resisting arrest. Classy.

    In this life one we have to be careful what you say or do the police may deservr whatever but remember they are law officals and sometimes you mught cus them, some thing happens and you fall right into the hands of the police or the police officer who you have cuss it is up to him or her to let you off the hook or give you a severe pushiment so if it is not a problem that needs attention sometimes you may have to let things go because the world is round and its axis is moving Prayers conquers things Remember it is the long arm of the law and an apolige on bothsides help to heal.

      Good point. The same is also true vice versa. The cops need to consider one may have a bad day and treat them with some level of humanity. What we dont want is a community that is angry with cops because they seem to lack basic understanding of people's needs as soon as they put on a uniform.

    Clear example of police being incapable and incompetent to de-escalate a situation. The man was probably on hard times. Not because you in uniform mean you cannot display humanity. Until police know how to handle these types of situations, they will always be incompetent in my eyes. That year was a terrible year for everyone and yes December 2017 was too early. Some people are still recovering from Irma till now. An apology letter to the office for the derogatory slang should have sufficed. Also, additional training to the officer would help. We trying to foster a sense of community are we not.

      Haha, thank you for making me laugh! When you put it that way, I think one's freedom of speech is a constitutional right. Surely he was just stating his own opinion and did not assert it to be a fact, unless he knew the officer personally and had the evidence to back it up. Very obviously, he was having a bad day, maybe fallen on hard times. The officer who should be the rational one could have changed the situation for the better but it is this type of talent that is seriously lacking in the force..ironically even, as the force is headed by someone who comes from a country where the officers are very good at handling these things. Justice in this case is bias...the officer needs training.

          Be honest, tell me these officers never frustrated you to that level of frustration before. Then add the situation of being in a struggle after Irma, having your daily struggles, then being stopped for an offence that you have no control over but would have been sorted if you were in a better position. It's not a matter of taking sides. It is a matter of considering all sides. Let us address the elephant in the room, those officers have no real life training.

      The word bitch by definition is a display of bad behavior...We will admit that a lot of women do display some real bad behaviors, Women call men Dogs all the time, thats how she sees his bad behavior, men ignore that, .So, as hash as it may sound, its just a telling someone that their behavior is really bad.... I can see the hurt feelings in it but i dont see the crime.... Then again we cant ignore the reception and perception, but is that enough to amount to an offence?

    My observation police need a class in how to talk to people. They escalate the already stressful situation. Then here comes the "bad words" and they get up in their feelings.
