Jamaican man pleads not guilty to indecent assault; trespassing charges
The Court, presided over by Magistrate Richards , understood that on the July 12, 2012, Mr. Gray, allegedly unlawfully entered the premises of another in the vicinity of Sophie Bay, Tortola, and assaulted a young woman.
Leslie-Ann Faulkner, prosecutor for the Crown, explained that during the day of July 12, 2012, the defendant allegedly visited the home of the Virtual Complainant (VC), unlawfully entered her home and assaulted her.
In Ms. Faulkner’s report, she disclosed that at the time the VC was resting, she allegedly felt someone kissing her on her ear, but she paid it no mind, thinking that it was her boyfriend. The court understood that because the kissing on the VC’s ear continued, she turned around and realized it was not her boyfriend, causing her to jump and scream; the defendant then left the room.
The report further indicated that the defendant allegedly came back into the room, held the VC’s feet and forced his head between her legs, forcing her to scream and struggle for help.
The court heard that at that time, the defendant allegedly told the VC that ‘this is going to be between me and you.”
In a summarized report coming from the VC, she told officers of the Royal Virgin Island Police Force, that she was unable to move, because of the force Mr. Gray had on her, while holding her down.
The report from police officers also quoted Mr. Gray as stating that he was invited to the home, so he should not be charged with trespassing.
It was stated that the defendant and the VC were friends before the incident.
Mr. Gray who has been in the Virgin Islands for eight years and was represented by Stacy Able, was placed on a $55,000 bail with two sureties and is required to pay a $5000 cash component.
He is also required to visit the East End Police Station every Monday, Wednesday and Friday between 6 am and 6pm, as well as hand over his travel documents to the authorities.
The defendant is scheduled to appear before the Magistrate's Court again, on September 18, 2012.
