Jamaican accused of punching belly of mother of 6-week-old
Daniel O'Connor allegedly committed the act on October 20, 2014 while at a home in Huntums Ghut.
Many heads nodded, swayed from side to side and some persons mumbled in disgust on hearing of the allegations put forward at the Magistrate’s Court by attorney for the Crown, Ms Chantal L. Flax.
O'Connor sat in the defendant’s box listening and showed no signs of remorse or guilt when it was stated that the mother of his child was in the bedroom sitting on the bed breast feeding their six-week-old baby when the accused approached and dealt her a blow in the naval region. The blow allegedly caused the woman to bleed from the vagina and she also allegedly bit the child on the arm.
A report was made to the Road Town Police Station and the victim had to be taken immediately to Peebles Hospital where she had to remain for treatment and later discharged.
The accused was kept in police custody for a ‘cooling off’ period before an audio/video interview was done during which he denied the allegations. He also denied the allegations in open court when the matter was put to him by the Senior Magistrate.
The court heard, however, that it was the second report of abuse made against him. The first had occurred on April 16, 2014 which amounted to unlawful wounding occasioning actual bodily harm.
When he had first appeared before the court at an earlier date for that offence, he was placed on $1,000 bail which was subsequently revoked on Friday last. Attorney Mr Michael Maduro presented to the court why he thought his client should be given a second chance at bail, especially on the grounds that through a signed affidavit the victim had indicated that she no longer wanted to pursue the matter. The woman’s words in the affidavit didn’t do his client any good.
The affidavit stated that the victim had confessed to dealing the Virtual Complaint several blows in the face. The prosecution had put it to the court that it seriously objected to bail as the defendant had breached the condition of his first bail as he had failed to join the Partnership for Peace Programme and was ordered not to get involved in any similar offense of abuse.
The prosecution felt that O’Connor was a possible flight risk as he is a born Jamaican that holds Belonger status and that he had a propensity to commit offenses of the sort.
At the end of the day, he was granted bail to the sum of $70,000 of which $10,000 had to be paid in cash.
Other conditions included no contact with the complainant; he was placed under curfew between the hours of 6pm and 6am. He was; however, given visitation to his child but the visitation should be supervised by someone from the Social Development Department. It is now compulsory that he attends and completes the Partnership for Peace Programme.
The prosecutor indicated to the court that Daniel O’Connor and the victim live together, but the Magistrate insisted that he cannot live with the VC any longer and said, "If he wants to live on the public road he can go and live on the public road but that's one thing I am clear on."
His next court date is April 21, 2015 when trial is set to commence.

we've been telling people all over the world for decades that for the most part, Jam......s are uncivilized. I mean their women make a living out of having baby after baby with different men of different nationalities just so they can collect child support. Get that mony from UK - get that mony from USA etc.

ridiculous!! I think he should be jailed. He has a pattern of violence. no remorse, we have no place in our society for these kinds of men whether he is from Jamaica or Tortola.

I am happy that she was persistent in taking the matter to court because Domestic Violence needs to stop
A verbal dispute is mere exchange of words but when people get physical and violent, it can result in something serious.
