After being sentenced to 11 years in prison on August 5, 2024, a Notice of Appeal was filed by attorney Richard Della Fera in the US District Court for the Southern District of Florida on September 19, 2024.
Third lawyer for Fahie
Mr Della Fera explained in a separate filing that he had intended to remain Fahie’s attorney for his appeal, but Fahie “is unable to afford to pay for an appellate attorney” and asked the court to appoint a lawyer to represent him for his post-conviction proceedings.
Fahie’s trial attorney, Theresa M. Van Vliet, also asked the court to withdraw as counsel in the case, as she “was retained solely through the sentencing in this case with Mr Fahie’s understanding and agreement.”
The appeal is being heard in the 11th US Circuit Court of Appeals, where attorney Benedict P. Kuehne has been appointed to represent Fahie, according to court records.

Mr Kuehne also prevailed against the U.S. Department of Justice in a test case in which he was charged, as a lawyer, with money laundering for reviewing and approving the propriety of legal fee payments to another prominent criminal defense lawyer for representation of a high-profile client prosecuted for drug trafficking.
In a long-awaited and highly favourable appellate decision of first impression, the Eleventh Circuit Court of Appeals declared that legal fees paid for criminal defense representation were exempt from money laundering enforcement. The Department of Justice promptly dropped all charges, resulting in Ben’s immediate vindication the day before Thanksgiving 2009, Kuehne Law reported.

He think because he hire an iron lawyer the appeals court is going to grant him an appeal? He might be granted an appeal, go back to court for a new trial and the jurors may find him guilty and the judge may send him back to prison. Dude, stop wasting money take your lick and serve the 11 years like a true man would.
years and be out with his family but want to risk that and end up getting an increase of sentence, dont seems too smart a decision.
But who knows how this appeal will turn out? We just have to wait and see.
