ROAD TOWN, Tortola, VI- The Cabinet Office of the Virgin Islands is notifying the public that the Integrity in Public Life (Amendment) Bill 2024, which was introduced and read for the first time in the House of Assembly on Tuesday, July 23, 2024, is now available for review.

The document can be accessed on the Virgin Islands Official Gazette website at https://eservices.gov.vg/gazette/.  This was published in an extraordinary issue of the Gazette No. 79 dated July 24, 2024.

It was the Virgin Islands Party (VIP) administration that passed the Integrity in Public Life Act, 2021 on December 22, 2021.

The Act sought to further strengthen the good governance of public officers, statutory boards, and elected officials in carrying out their duties.

Amendments

Legislators are now seeking to make amendments to the bill following an Independent Review conducted by attorney-at-law Denniston S. Fraser.

One of the changes to the Act is the addition of Section 14A, which grants the Integrity Commission the power to impose fines of up to $5,000 on public officials who breach the Act’s provisions.

    Let's face it. Nobody has confidence in the public review process, or that those outcomes get reflected by the House of Assembly. The public review process is just a box-ticking process.

    If there was any seriousness to this, there would be an explanation of what the amendments mean and an attachment to the original piece of legislation being amended. The general public needs to understand this, but won't, and there has been no real effort to give them the tools to do so.

    The Integrity in Public Life Act is not unique to the Virgin Islands. In other countries in the Caribbean and elsewhere, it is referred to as the Integrity Commission Bill. What it simply state is that All members of the House of Assembly and senior public officials Must declare their interest as well as their assets to the commission to ensure that public officials are not involved in illegal practices. It must be done annually at a particular date or time frame. Failure to do so will be a breach and punishable with fines and or imprisonment. We should examine other jurisdictions acts before showing dissension to the bill. It is as clear as crystal.
