‘I am very heartbroken’- Mother of minor indecently assaulted by policeman

ROAD TOWN, Tortola, VI- The mother of the female victim who was indecently assaulted by a police officer on two occasions, including at a police station in 2015, has expressed frustration that the offender was not given the maximum sentence.

Harris Walters was found guilty on two counts of indecent assault on a minor in the Magistrate’s Court on May 29, 2024, and sentenced to 32 months imprisonment (or 2 years 8 months) on each count, to be served concurrently.

The sentencing of Mr Walters was done by Senior Magistrate Tamia N. Richards on Wednesday, March 5, 2025.

The maximum sentence for the offence, according to Virgin Islands' laws, is three years.

‘Give him the full three years’

“I am very heartbroken. Give him the full three years,” the distraught mother told our News Centre on Wednesday.

She further argued that the “slap on the wrist” sentencing will only embolden persons like Mr Harris to prey on underaged girls.

The mother further called for a sex offenders’ register, as “there is too much molestation of our innocent children.”

    She is right to be upset, the fact he was a serving police officer is an aggravating factor in most jurisdictions and he should have received a much harsher sentence. Unfortunately, most of the BVI laws are outdated and inadequate, but every time the Government try to strengthen them there is protest - the new Police Act being a prime example!

    WE NEED A SEX OFFENDERS REGISTRY AND FOR IT TO BE MADE PUBLIC. CANNOT HAVE THESE PEOPLE WALKING AMONGST OUR INNOCENT KIDS. SAME ONES BE SMILING IN YOUR FACE. IT GOING BE TOUGH DECISION SINCE ALOT OF THEM FRIENDS WITH POLITICIANS OR THEY THEMSELVES ARE OFFENDERS.

    GOD don't give a man more than he can beer I don't like no police but I don't wish jail for anyone. If Mom feel he did get the time she could have taken the law in her hands. I was there jail is no place for man the court make a decision let the man do the time.

    My question is why is the maximum for this offense is only 3 years that make sense? There is no justice in our justice system. Y’all would crucify somebody for a lil weed then slap a pedo on the wrist like it’s not a big deal. I makes you wonder why we can’t even get a sex offenders register. Everybody can agree it’s a good idea but nothing ain’t happening with it is anyone even working on it?

    Because he was tried in the Magistrate Court (summary trial), the maximum sentence is years , not 3 as the article stated. See Section 138 (1) (a) of the Revised Criminal Code 2013 (Page 67). In other words, he was facing 10 years max for the two counts, and only got 2yrs and 8mths. If the trial had occurred in the High Court (judge and jury), he would have faced 10 yrs max for each count.

    We need a registered sex offender list in the BVI
