DUFFS BOTTOM, Tortola, VI- Two motions to prevent Deputy Speaker Hon Neville A. Smith (AL) from having to vacate his seat as a legislator because a company he is affiliated to is seeking to or has entered into contracts with the Government of the Virgin Islands, will be moved at the 12th Sitting of the 3rd Session of the 4th House of Assembly (HoA), which starts today, September 22, 2021.

Motions to exempt Hon Smith from Vacating HoA seat

According to the Order Paper, Hon Smith is the Director of Caribbean Security Limited, which is desirous of providing services to the Government of the Virgin Islands for the installation of Access Control, Video Surveillance and Burglar Alarm in the Ministry of Finance and additional installation including Building Wide Fire System at RFG Place, Road Town, Tortola for a total contract sum of Eighty-seven thousand and thirteen dollars ($87,013.00).

In a second motion, also to be brought by Premier and Minister of Finance, Hon Andrew A. Fahie (R1), exemption will be sought for Hon Smith to not have to vacate his HoA seat since the Government of the Virgin Islands, through the Ministry of Finance, entered into a contract with Caribbean Security Limited on December 6, 2019 for the delivery of items such as access controls and intercoms for the refurbished Police Headquarters at Sir Olva George’s Plaza for a total contract sum of fifteen thousand, nine hundred and eighty dollars and twenty-four cents ($15,980.24).

It was on July 29, 2021, that the HoA voted to exempt Hon Smith from vacating his seat after the company the legislator is a Director of entered into two contracts with the Government of the Virgin Islands.

What the constitution says?

Section 67(3)(e) of the Virgin Islands Constitution Order, 2007 (U.K.S.I. 2007 No. 1678) provides that subject to subsection (7), an elected member of the House of Assembly shall vacate his or her seat if the member becomes a party to a contract with the Government of the Virgin Islands for or on account of the public service, or if any firm in which the member is or becomes a partner, or a company of which the member is or becomes a director or manager becomes a party to a contract with the Government of the Virgin Islands.

Section 67(7); however, provides that if in the circumstances it appears just to do so, “the House of Assembly may exempt an elected member from vacating his or her seat under subsection (3)(e) if the member, before becoming a party to a contract, or before or as soon as practicable after becoming interested in a contract with the Government of the Virgin Islands by virtue of being a partner in a firm or director or manager in a company which has a contract with the Government, discloses to the House of 14 Assembly the nature of the contract and his or her interest in the firm or company involved in the contract.”

Meanwhile, the Opposition will be waiting in the wings with some 44 questions ready to be fired.

    where some folks residing in the virgin islands come from then based on the complexion you have nothing. so up arrival they shock to understand how come a certain sector of virgin islands society own property or even have a profit making establishment.....based on complexion in this world you are classified as a second class however vi people are very prosperous with that foundation coming from our ancestors

      There's a way to do things. The COI has exposed that alot of our people are SIMPLE AND DUMB and should not be leading this Territory. Imagine sitting infront of the UK people that you claim should just leave us alone but you don't know what the meaning of a contract, you didn't read the Constitution but you are an elected official, you didn't understand a simple form and the list of simple stuff goes on and on. Some people should stay in their lane and that's what the COI will expose. Of course we know many of the UK people don't want to see us with anything but we only make matters worst by being boastful and dumb at the same time.

        He must know what a contract is... and how to fill out a declaration form, since he worked at a law firm for more than 20 years and rose to the rank of a manager. I would not call him simple or dumb, but it seems like he was coached to just deny knowledge of these contracts up to a certain point.

        If I was hauling in significant sums from these contracts as a "cheque-signing director", I would still want to know about them.

    While I have notthing against Sheep, i kno for sure he is a great guy, but why gov't giving him alone all the automated Security Jobs, only he alone have to eat? Come on man this where we getting into trouble. Conflict of interest is real in our little beautiful paradise. We have to do better than this.

      Did you bother to research the circumstances around the issuance of this Contract? If so, do you understand it's context or you just hating? No matter what concerns individuals that others dislike there will always be NEGATIVITY that's why shadows are cast on BVIslanders

    All politicians and Government official should be banned from having any contracts from the Government and that includes their family and close friends. It should be against the law for them to profit whilst being in office.

    The contracts should go to the companies that will offer the best service for the best price to the taxpayer. Where contracts are going to companies which are connected to HOA members, the full tender process and copies of the contracts should be made publicly available for the electorate to understand how the contract was awarded and what they are supposed to be getting for their money.

    The problem we have is that members from both parties are happily taking advantage when in power and there is no accountability for cost overruns or shoddy works. Do we have any politicians that are genuinely in it for the wellbeing of the territory rather than just their bank balances?

    It's amazing how these people does enter government innocent and get in there and all you can see is self interest. What happen to the bidding process and conflict of interest that should disqualify all government officer which could influence the out come.
