DUFF’S BOTTOM, Tortola, VI – Minister for Transportation, Works and Utilities, Hon Kye M. Rymer (R5) has said the Explosive Amendment Act 2021, is another effort by the government to deter gun crime in the Virgin Islands as well as to ensure guilty persons do not escape prosecution due to loopholes in the law.

The Bill, which had its first reading on March 4, 2021, sought to amend section 2 of the Principal Act, by widening the definition of the word explosives, so that it includes explosive materials which may be used in firearms as ammunition, including articles consisting of a cartridge case, blank cartridges or training cartridges.

Gun crimes have no place in VI - Hon Rymer 

“Given that what has been occurring in this territory as it relates to gun crime, this government, we have bemoaned the fact that gun crimes have no place in our community,” he said during the Ninth Sitting of the Third Session of the Fourth House of Assembly of the Virgin Islands held at the Save the Seed Energy Centre in Duff’s Bottom on May 13, 2021.

Hon Rymer continued, “Mr Speaker, gun crime is like fungus, that eats away at the very fabric of us as human beings. Within our territory we are embedded in a community deeply rooted in religion, family, hardships, hard work and, Mr Speaker, gun crime has no place in our community so we will extend every effort to strengthen the legislation to widen the definition of the word explosives.”

He said through the widening of the definition, persons convicted of gun crimes will be prosecuted to the fullest extent of the law and not released because of technicalities resulting from the definition in the legislation, not being wide enough to cover explosive materials used in firearms.

The Minister said that in a 2020 case, the Court of Appeal ruled that it was a mistake of law for the magistrate to have accepted a guilty plea on the basis that ammunition as defined by the Firearm Ordinance Cap. 126, was not included in the definition of explosives under the Explosive Ordinance Cap. 124. 

Difficulty changing persons founds with ammunition 

“There is no criminal charge under the Firearms Act, Chapter 126, as amended for the possession of ammunition and explosives,” he said and that as a result of the judgment, it prevented persons from being charged by the police and being brought before the court by the DPP, to be prosecuted for the possession of ammunition and explosives. 

He said in many cases, police officers would find explosives and ammunition and be unable to lay charges as a result of the Court of Appeal judgment.

Hon Rymer said law enforcement will now get legislative backing through the Explosive Amendment Act 2021, to arrest persons found in possession of explosives and allow the DPP to prosecute for the unlawful possession of explosives such as those used in firearms.

The Bill was debated and passed without amendments in the HoA on May 13, 2021.

    All this is just jaw boning, until there is mandatory stiffer and mandatory sentencing for gun related crimes.

    I agree with putting a stiff penalty in place for guns and ammunitions'.
    We need to continue doing stop and search in different areas at times.
    Don't give those persons found a break at all.
    Let them suffer the consequences.

    You’ll herd what was being said yesterday on Tola Radio by Mr. Penn? “ no criminal, guns or drugs “ ain’t a problem within our community. Can’t believe people actually take this mad man seriously!! Crazy how a Rastaman or a man that says he’s a Rastaman could actually be so naïve. He’s drinking, he’s smoking calling people names without actual facts and just being encouraged by people with no common sense. The Penn’s must be very proud.

    the issue is enforcement some living here gets upset when this matter is raised and try hiding behind the police can not be everywhere or the people not giving information to police but the majority of the time you see a flock of police after the crime is committed. road town is the capital of the virgin islands and on most days there is no police presence and we all know when the cat is away the mice comes out to play. hardly any effective sea patrols so the dope, guns and humans continue to flow into the territory. the focus is financial services or tourism while homeland security sits in limbo more attention should be given to law enforcement

IF WE ALL AGREE, AND BEGIN PRACTICING SELFLESSNESS, RATHER THAN CONTINUING PRACTICING SELFISHNESS, GUN CRIMES WILL BE DELETED IN OUR CIUNTRY. GUNS DON'T COMMIT CRIMES.     Unfortunately these are some of the developments that come with development and what is termed progress. Has anyone noticed that with the progress life is becoming more hellish. We are raising animals and cannibals who are being programmed by Hollywood, the media, the drug world, gangster culture and a host of other negative influences that are glorified by the love of money,fame and power. Unless we are able to make some drastic changes to the way we do business there is nothing that can stop this monster that we are creating. No amount of jail time or other penalty will make a difference to those with this mindset. The problem calls for a comprehensive approach and not just a big stick or more and bigger guns. The suspicion surrounding the vaccine proves that people have lost faith in government. Time for some serious reflection and tough decisions CHANGE COURSE NOW.

    I agree with your sentiments but this is an easy fix, in my opinion. The reality is the unsettling in the VI can be attributed predominantly to one predictable demographic portion of the VI. Curtail and minimize the growth of thIs segment and subsequently elimination ,is my opinion.

    Guns, drugs, the huge demand for them are what created and maintain bothe industries.

    Owning a gun does not make one a criminal. Hurting or taking a life. with one makes one a criminal.

    However, the greatest and most abundant criminals ae those who dress up in suit and tie everyday and commit their crimes.

    However, those criminals are viewe and respected as good and respectable citiznes.
