Father gets 11 years for molesting daughter
The Sea Cows Bay resident was sentenced to eight years for incest and three years for indecent assault. The sentences are to run consecutively.
Due to the sensitive nature of the case, media houses were asked not to publish the convicted man’s name, since the Virtual Complainant (VC) could be easily identified.
After a four day trial that concluded on Thursday November 3, 2011 in the High Court, a nine member jury returned unanimous verdicts on the sexual related offences.
The 43 year-old had been charged with three counts of indecent assault, two counts of incest, three counts of buggery and two counts rape – however, he was found not guilty on the two latter offences.
Since his arrest in early July, the Virgin Islander had maintained his innocence. He was represented by Patrick Thompson. Principal Crown Counsel (ag) Tiffany Scatliffe appeared for the Crown.
The Crown’s main witness was the daughter, who testified via video link. Other witnesses include the investigating officer (IO), the doctor who examined her and the mother.
According to court records, the incidents came to light when the VC took a "highly sexual book" to school, prompting the school’s principal to contact her mother, and a conversation between mother and child revealed some disturbing facts.
Ultimately, she was taken to Eureka Medical clinic, where it was discovered her hymen was not intact. This revelation sparked a police investigation.
