Ex teacher found not guilty of indecent assault struggling to move on with life

ROAD TOWN, Tortola, VI- Jevaughn A. Nibbs of Ballast Bay was found not guilty of indecent assault by a Magistrate’s Court on Tuesday, November 19, 2024.

He was charged with eight counts of indecent assault on March 24, 2022, and was subsequently terminated from his teaching job.  

“I was a teacher, and the accusations came from my students,” he told our News Centre in an exclusive interview on Wednesday, November 21, 2024. “I was terminated within like the first three months.”

When asked if he would like to be reinstated in his previous job now that the court acquitted him of all charges, Mr Nibbs said he does not.

“It kind of left a bad taste in my mouth and put me through the wringer, isolation, ostracised, name called, blacklisted, I can’t see myself wholeheartedly going back to it. I would have a sceptical mind towards students, the faculty, I wouldn’t be at ease, I wouldn’t be settled,” he explained.

Mr Nibbs added that he was employed as a teacher with the government and when charged was not given leave until the case was called and a verdict given. “I was terminated effective immediately,” he said.

Seeking compensation for wrongful termination

Mr Nibbs called his firing “wrongful” and an “injustice”, telling our News Centre he would like to be properly compensated for being terminated from his job as a teacher, a job he held for almost two years.

“For me immediate would-be compensation, to get something so at least I can start back...our whole savings got run through just with lawyer fees and then I still had to turn around and represent myself,” he explained.

His family has also been affected, the husband and father of two said. His wife, who was also a teacher, decided to resign from her job in order to “have peace of mind”.

None would hire him

Mr Nibbs said since being accused and arrested for indecent assault, he was unable to find employment elsewhere for a long time and relied on doing “gigs” occasionally.

“I had people who only offered me an interview just to inquire about the matter and... because I didn’t want to speak on it, then you know they don’t think they could trust me to have the job because of it,” he stated.

Earlier this year he was offered another government job as a labourer. With a bachelor’s degree in accounting, Mr Nibbs said after applying to several government jobs, the only one he was offered was to sweep the streets.

Mr Nibbs said he just wants his name cleared in the media since the whole ordeal has affected his life.

“If anybody googled my name that was the first thing that was popping up you know, which took a toll on anything I was trying to do with my life...like I say it was a blacklisting and a labelling, all types of things,” he said.

He hopes sharing his story will bring this chapter of his life to a close.

To someone who may find themselves in a similar situation, Mr Nibbs said to ignore the noise of the crowd. “You have to have your own sanity and trust in God to pull you through whatever...believe your truth regardless of what the noise is around you.”

    SO what happens to those lying WHO***G children? When they don't like you they can ruin your life with lies false accusations? No penalty for the lying children right? Oh they minors they didn't know better right? I know it have sicko in the profession that really did these things but what happens when its a total lie.

      Nothing happens to them they just grow into adults and repeat the same things to get their revenge on ppl. Meanwhile the real victims are being ignored. Why, because when these liars get caught it makes it seem like everyone is lying.

      It is called defamation!!! and the parents of those minors are liable for damages. in this case lost wages. In addition, a wrongful dismissal suit against the Government (which they will settle). Everything in God's time. just a bit longer. compensation is very possible. You have 2 strong cases bro.

      What are you talking bout we live in a place where you can go jail and come out and run for politics and get appointed to boards and get consultancy contracts. Where you can break the law repeatedly get caught and still be on the road breaking the law. Where you can miscalculate the budget by 20 million and still have a job. BVI is land of second chances.

    God does not sleep, God is fair, it happened to a local person who was able to fight for his last name, imagine a "Jew" not to go too far and I tell you there is no metallic compensation to cleanse that family, this student must also be recognized in society because she is dangerous even though her conscience has not let her live.

    He is right. They think that can do all manner of illness to people and destroy them and not compensation. The next set that need compensation are those are from found not guilty and stayed in jail long after the time.

      We once had a Prosecutor in the DPP office who worked hard and was very capable, but got a lot of fight and left. Britain needs to send us another good and qualified prosecutor, Seems like almost. Everybody charged for serious crimes walking away. Wonder why.

        It's stated in the BVI Labour law: That once an employee works for an establishment for over 12 months. They are automatically permanent and pensionable with the establishment.

    Internal discipline would have been the best approach in dealing with this matter. To know the truth and not rush to a criminal court where the case has to proven beyond reasonable doubt. Once there is any doubt, the case gone through the window. The young man has to be appropriately compensated.

    Young man, seek punitive damages!

    Only remuneration, in massive amounts, can restore your good name

    ..And don't forget to also sue, for loss wages-now and in the future, and the emotional distresses- on you, your wife and family,- and your health!

    It is in these types of solutions, where lessons can be learned!

    Mr Nibbs I would sue fir defamation of character, lost wages, depression etc. Someone has to pay for this. We teachers nobody stands behind us at no time at all. These children sit watch television and play out what they see. I wish they were this dedicated to their school work.

    QUESTION..WHY IS IT THAT THE BRITISH VIRGIN ISLANDS IS ONE OF THE ONLY COURT SYSTEM THAT DRAG CASES FOR YEARS BEFORE THEY DECIDE IF SOMEONE IS GUILTY OR NOT GUILTY? MOST OF THE TIME THEY ARE ONLY CAUSING MORE HARM THAN GOOD ON THE ACCUSER. WE NEED TO DO BETTER!

    The BVI is a small territory where basically everyone knows each other. In most cases you are known by what you were accused of, whether innocent or not. It is very sad but this is the stigma we face in our society.

    There is no plausible reason as to why this case should’ve taken 2 years to be resolved. The courts need to do better. They also need to explore sealing these proceedings and use the utmost discretion with the defendants identity as they do with the victim. This young man’s name has been stained and who knows how long it will take for him and his family to fully recover. He has suffered a great injustice.

    Accusations of this manner are very serious and should be handled as such but there needs to be some sort of confidentiality as to not permanently tarnish the innocent.

    Thats what teachers do. We all went to school and know the foolish thievery and mockery kids do to the teachers. Bad apple kids make it harder for everyone. Decades later some of those sticky fingers never were caught.

      These children are deadly! They steal teachers belongings and have not respect and nothing is done. However everything that comes out of their lying mouths are perceived as gospel. These children have no home training! Blame the parents that are dragging them up.
