Eleanor King beat her lover’s woman on Valentine’s night
It was the drama of that night that the court commenced hearing this yesterday October 13, 2014 before Magistrate Ayana Baptiste-DaBreo with the complainant took to the witness box.
Ms King pleaded not guilty to the charge of common assault as occasioned on February 15, 2014. She decided to stand her own defense yesterday in court and had to be cautioned on several instances about her line of questioning which for the most part she frequently appeared to have been admitting to have committed the offense and was directing questions that were not relevant to the crime of common assault which she was accused of.
“The way you are phrasing your question you are admitting to hitting,” said Magistrate Baptiste-DaBreo on one occasion and at another instance told the defendant, “Cheating is not an excuse for hitting a person, not in the court of law, not at all.”
In giving her testimony the complainant told the court of the circumstances surrounding her being in bed the night of February 14 with Mr Barnwell before they fell asleep after their time of watching TV among other things and were disturbed by the accused.
The woman told the court that she and the man had a relationship since 2010 and up to the time of the incident their relationship was on and off. She recalled they both being asleep after they had gone to his house after some time spent at the beach in Beef Island.
She recalled being alerted to the bedroom door hitting the bed and noticing the lights of the room on and there was Ms King in the room.
Her story was that Ms King unleashed about three blows to her body in the region of her face which resulted in bruises, injuries to the eye, extensively swollen face and hand which she had raised in defense to the blows that were being unleashed at her by Ms Martin.
She said that it took valiant efforts of Mr Barnwell to subdue the angry woman. She said she was lying in one of his arms on the outer section of the bed while the man was on the inner side.
Under cross examination the accused who represented herself, sought to establish that she was acting in self-defense and that she was actually beating on Mr Barnwell before turning in her defense against the woman he was with in bed that night, claims which the complainant denied.
“Your honour, look at my size and look at Ms Martin’s size, if I had hit her she would have had more damage as she is alleging,” said King. Martin had put it to the woman that she had hit her in the face resulting in her beating her in the face.
There was also testimony of Mr Barnwell being injured during the fracas.
The drama is scheduled to continue unfolding on November 27, 2014 when the Prosecution is expected to call Mr Barnwell and his father who was awaken by the turmoil as he was in the next bedroom.
