Danny Benjamin’s re-trial to start soon
Back in 2012 the man was found guilty of the offense and sentenced to 10 years in prison by Justice Albert Redhead, who during the sentencing had told him of the seriousness of the offense which he said, based on photographs that were presented in court during the trial, the victim’s head was almost severed from his body.
However, following the sentencing, Benjamin, through his then lawyer Mr Patrick Thompson, moved to the High Court and appealed the judgement. The Court of Appeal ordered a re-trial on the grounds that they found that Justice Redhead failed to give proper directions in self-defense among other things.
Following the order of the Court of Appeal, the High Court granted Benjamin bail at $75,000 with one signed surety and that he surrendered his travel documents, report to the East End Police Station weekly, stay away from the witnesses, and that he not visit the bar where the incident allegedly occurred.
Yesterday in the High Court, Benjamin told Justice Byer that he had no legal representation but is trying to get Legal Aid to assign him one.
Justice Byer told him he is expected back in court on October 14, 2016 for report and if at that time he does not have a lawyer, the court would decide if the trial will go ahead with him representing himself or if other options would be looked at.
