Court quashes appeal by attempted murder convict Jevone Demming
Demming, of Virgin Gorda, was jointly charged with Sherman Williams for attempting to murder Neil St Rose on September 30, 2012.
High Court judge Nicole P. Byer had sentenced Demming to 7 years imprisonment and Williams to 15 years in jail on February 2, 2015. The duo had been found guilty by the jury on October 22, 2014.
Appeal
Demming, through his lawyer Patrick D. Thompson, made the appeal to the Eastern Caribbean Supreme Court (ECSC) on the basis that the trial judge led the jury astray on the “law of joint enterprise thus rendering his conviction unsafe and unsatisfactory.”
In its published verdict, on January 14, 2020, the ECSC said Justice Pereira’s reasons were based on “the basis that no miscarriage of justice resulted from the judge’s misdirection to the jury.”
Court’s version of events
According to court documents, on September 30, 2012, Williams, Demming and St Rose were at the Rock Café on Virgin Gorda attending a social event.
What started as a push and shove episode between the three men, turned ugly when St Rose left the food establishment and headed to his vehicle.
He was followed by Demming and Williams who was armed with a gun into the parking lot.
Williams fired a shot and when St Rose turned around, he was beaten by both men and shot at close range by Williams, one of the injuries was in St Rose’s scrotum area.
Demming received 7 years and Williams received 15 years for the crime.
In addition, Williams got 10 years for the offence of unlawful possession of a firearm.
The firearm was never recovered.
