‘Concerned Citizen’ saddened about individual rights violation

ROAD TOWN, Tortola, VI- In a social media message circulating today, Monday, May 13, 2024, on Facebook and the WhatsApp platform, a resident describing themselves as ‘Concerned Citizen’ has raised many issues over what they said is “unconstitutional to have individuals rights continuously violated.”

The unknown person raised two issues, first the recent decision where a Judge ruled in a Judicial Review case brought by Comptroller of Customs Mr Wade N. Smith against the Senior Magistrate, Tamia N. Richards, and the Commissioner of Police, Mark Collins.

The judge was clear that Mr Smith's rights were violated when Ms Richards agreed to a search warrant of Mr Smith's home and the judge ruled that the search warrant was illegal, unreasonable, unjustified and lacked substance.

Still on the job, no sanctions

The ‘Concerned Citizen’ wanted to know why “these Magistrates [Tamia Richards and Crystalyn Benjamin] are still sitting without any review or investigation of similar cases.”

The next issue raised was when a police officer and former President of the Police Welfare Association Mr Sean A. McCall filed two motions regarding a search warrant issued for the search of his cellphone and for sending him on leave. The 'Concerned Citizen' described the situation as an ‘abuse of power.’

In the social media post by the ‘Concerned Citizen’, they asked “When is this going to stop?”

The 'Concerned Citizen' noted, “We need to call on the JLSC (Judicial Legal Service Commission) for their intervention, we need to call on His Excellency, the Governor and the Deputy Governor, who are responsible for the Magistrates, for their urgent intervention. All three of these institutions have a responsibility to ensure and promote fair justice.”

Legal & police system weaponised?

Many residents in the past eight years have raised issues where it appears that the Police Force and the legal system have been weaponised against residents who are outspoken and critical of the Police Commissioner and the Governor.

Some have alleged there is a target list of prominent residents to be arrested and charged in an attempt to damage their characters, even after being told that the evidence is weak against the persons in question.

    Talk about breach of trust, we’ll look how they rest breach of trust on locals and breached all trust with no consequences. We have local senior magistrate, local DPP and local A.G and they t*** up with the U.K to illegally oppress their own? What a shame

    I DID MAKE A REPORT ABOUT ONE THE POLICE OFFICER AND THEY TOLD THEY CANNOT DO ANYTHING I MUST LET A LAYER WRITE TO HIM WHICH I DID AND STILL NO RESULT. BVI POLICE OFFICERS ARE JUST CROCKED.

    Many citizens are been side swiped in the BVI , from Labour to Prison.my suggestion is to become knowledgeable and beat them at their own game. Labour have reports where employee are disadvantaged from their jobs because of how employers feels, silliness little things they fussed about.

    We who like to organize march and peaceful protests? Why haven't we organized a sick out or some other form of protest allowed by law? The Governor and COP need a clear message that we will not tolerate his abuse of power. When we should protest we don't and when not required, we out in the hot sun making noise with a truck and sound system

    they damaged the nerves in my hand with the handcuffs in Oct 2018. I am a classical pianist. They haven't said
    A thing despite hundreds of communications from here in the US. Hundreds of communications to the Premiers
    and Governors offices as well as to the UK government itself. If they can't behave or be accountable for their actions
    then they can be tortured or amputated or killed. I'm thru with diplomacy. If these people are caught in the USA
    they will be arrested and the matter equalized. Or maybe a squad can be sent to Tortola to dispense justice.

    Let's not forget about paul france, he lived with this fella, and accidently drowned in a car? France was known as a great officer and every other person knows what happened to him was corrupt. I think we need answers
