Chalwell family blocks roadwork on disputed land @ Fat Hogs Bay

FAT HOGS BAY, Tortola, VI- A family in Fat Hogs Bay is actively protesting the use of its family property for a stretch of roadway in Fat Hogs Bay on Tortola, going as far as putting down poles on the disputed area.

The stretch of land runs about 800 feet along the shoreline between the former Pussers East and Hodge’s Creek Marina and includes a section of the current roadway.

“This is ours, but we are not fencing it because we are bullies. We fencing it for our rights.” Mr Mickey Chalwell told Virgin Islands News Online in an exclusive interview on February 24, 2025.

According to Mr Chalwell, the area always belonged to the Chalwell family and was bought by his now-deceased father Mr Kenneth Chalwell many years ago.

He said the government is aware of the land being private property and was recently reminded of the roadway infringing; however, it has refused to address the issue with the family.

“We have always been open for discussion to solve the problem, but we waiting on them months now and they are not coming,” Mr Clyde Chalwell stated.

According to the Chalwells, the issue is not about money as they are not interested in selling the property.

“You not going to bully your way to this local family,” Mr Clyde Chalwell firmly stated.

Efforts to get a comment from Minister for Communications and Works Hon Kye M. Rymer (R5) and his Permanent Secretary Elvia Smith-Maduro were unsuccessful.

However, the Director of Public Works Department (PWD), Mr Jeremy W. Hodge, said, “The Ministry of Communications and Works is working on the matter.”

Meantime, the contractor for the road works at Fat Hogs Bay has discontinued working in the disputed area.

The road is currently closed to the public.

        @ Yo and Winston. You are WRONG! It seems the country does not care about the rightful owners of the property. Imagine you are sitting on your porch and the government comes digging up your property because they feel like it, making you go inside your house because they need that stretch of land your porch is sitting on. There should be respect for the legal land owner of the property, instead of the government bullying their way in. There should have been a meeting with the land owner before work began on the road respecting the boundaries. Maybe they all could have come to agree on something. Now everything is frigged up!

    How about the government charges the chalwell a fee for keeping an abandoned property aka fat hogs bobs thats 100x the cost of what they are asking for, for their easement issue. Then pay them rent on the disputed land, and then the other 9/10ths of the money collected, put it towards the cost of building the road?

        It can't be me,because that's place is a hazard if a storm should hit,just as junk yard,lumber and other debris from that place could fly and hit other properties during a storm,that place was like that for hover 7 years so do don't talk about abandon,look like you need glasses or you don't live east end.

    So for how many years that chalwell family been driving on the piece of road with their trucks, cars bikes etc. That means it been in use now ever since that road was originally cut, which means the road now defines the property boundary.
    Government.. do not bend.
    There are laws which govern this...use them
    Or, what about a simple compulsory purchase which is well within the rights of the government
    Dont let all these land disputes bully you government. Stand firm for once, dont pander to the wants of your families and friends. Grow a pair and deal with it head on.

      So you see this as a white vs black issue? Interesting. In my view, I don't care what color you are in this dispute. If the government finds it necessary and reasonable to use the land on your side (which is a tiny area from my observation), to construct the road properly, then what is your problem? I doubt this is all about white vs black. Perhaps the road engineers can educate you on this but imo, it's a silly fight not in the best interest of the public and road safety. If land is needed to build roads properly, imo, it does not matter the color of the person(s) who own it.

    If I was government, I would put a 3ft wall from wherever their land started down by the marina, take it straight up and around the corner.

    Just leave an entrance to their property down by the marina. Let them develop their land where they put up post so they have an entrance and exit.

    I’m not an advocate for Willy nilly taking private property. But building a major public road is a good use for a compulsory purchase ( eminent domain) for the public good..The government need to offer the Chalwell family the market value of land and if they refuse employ Compulsory Purchase. Why was not all this resolve before the project started? Some may argue why government does not do the same for the Ellis Thomas Downs.
