BVIFSC publishes 'quick guide' on trademark registration

PASEA ESTATE, Tortola, VI- The BVI Financial Services Commission (BVIFSC), as part of its continuing efforts to educate the public on matters related to financial services, has launched its newest publication titled – Trademark Fundamentals.

BVIFSC in a press release said the brochure, which was published through the Commission’s financial literacy education arm – MONEY MATTERS BVI, has been described as both informative and motivating by readers.

It is expected to serve as a quick guide for existing and aspiring entrepreneurs who are contemplating taking steps to protect their business brands through Trademark registration.

According to the press release, the brochure is also instructive as to how to go about registering a Trademark in the VI, providing Commission website reference to the following key documents: Trade Marks Act, 2013; Trade Marks Rules, 2015; and Published list of Registered Trade Marks Agents.

Importance of trademark registration

Chief Executive Officer and Managing Director of the Commission – Mr Kenneth Baker, commented, "While most of the businesses who should consider Trade Mark registration will not fall under the supervisory and regulatory remit of the Commission, we still have a role in overseeing legislation such as the Trade Marks Act which in a nutshell, facilitates the identification of goods and services in commerce and the protection of proprietor rights. 

“We are all familiar with brand identifier marks; however, the importance of this Brochure is underscored when proprietors are made to understand that if a mark is not appropriately registered, it will not have the protections afforded through law as their legitimate and personal property, irrespective of how unique it is,” Mr Baker said.

    Thank you. But what would be more helpful is allowing locals to submit their trademark registration without having to get a lawyer. It is expensive and prohbitive. Here does not support or empower local business to thrive. Too much focus on revenue generation from fees instead of strengthening the populace to become business owners with trademarks, patents and actual trade licences so that we can drive the economy. It is too prohibitive here!
