Broderick Penn blasted for demonising clampdown on defaulting charter boats

- Customs Officer accuses Penn of double standards & encouraging lawlessness

ROAD TOWN, Tortola, VI- Recently persons in the yacht charter industry have taken to social media to complain about the clampdown by HM Customs on vessels not in compliance with the territory’s laws, including not having a valid license or safety certificate.

Lending his voice to the complaints was local Mr Broderick Penn, the Director of Enforcement at the BVI Financial Services Commission, who was quickly criticised by an HM Customs Officer who accused Mr Penn of being hypocritical, political and condoning lawlessness.

In a Facebook post today, March 17, 2022, Mr Penn, a former Premier’s Office Permanent Secretary under the former National Democratic Party (NDP) Administration, said he was waiting for a sensible explanation to what he termed a “charter yacht detention debacle” and that he was still waiting for someone to explain why vessels are being detained.

He also claimed that the measures have “also chased many local operators off the sea in the same manner.”

“Surely the answer cannot be because they do "not have a recreational commercial license or ‘we are enforcing our laws?’"

Mr Penn suggested that unless there is a safety issue to operating the vessel for not having the license, it would be better to just impose a fine on the operators.

“Instead we choose to physical disrupt the business that is the life blood of our economy which we are just making strides to build back. And on top of that we create an unpleasant, disruptive and unfair experience for our sailing guests. And if that wasn't good enough, we create a PR nightmare for the industry and the BVI. I mean how did we think this will end? And the Gov't is silent on the matter,” Mr Penn contended.

Mr Penn accused of double standards

Among the response to Mr Penn’s post was Customs Officer J. Winter, who called out Mr Penn on being hypocritical and possibly grandstanding for political reasons.

“As a young law enforcement officer, I will not be discouraged by those comments. However, what is concerning is that you as a Financial Service Regulator would make such a comment that condones Businesses operating in the territory without licenses,” Winter wrote.

Politics @ play?

The young Customs Officer also questioned whether Broderick’s views were not coming from a political platform/agenda.

“In my interpretation, this post clearly sends a message that anyone can come to the BVI and operate without following the laws of our country. This would not be the leadership anyone would be looking for.”

According to Winter, the charter companies in the VI generate revenue in excess of $120M monthly and commercial licenses and safety equipment per unit costs approximately a few hundred dollars. “Once all safety requirements are met and necessary documents are submitted to Customs, they are good to go!”

‘Zero tolerance’

Winter said HM Customs has “zero tolerance for vessels that are lacking safety certificates (which IS usually the case) because it speaks to the safety and lives of our guests.”

The Officer also said HM Customs has held many symposiums educating all interested parties on the requirements so there should be no excuses when HM Customs is doing compliance checks.

“I suggest you do some more research on this matter before publicly attempting to discredit the integrity of Her Majesty’s Customs,” Winter wrote.

Concern not political- Penn

Mr Penn then claimed that he was not playing politics and he was just expressing concern for the industry.

“I should say though it's quite a false and inaccurate assumption that my concern is political. Trust me it's not! Nor would I EVER attempt to discredit any law enforcement agency.

My concern is for the impact of the action on our Tourism sector,” Penn responded.

Meanwhile, efforts to reach Commissioner of Customs Mr Wade N. Smith for clarification on the detention issue were unsuccessful up to time of publication.

    Personal have nothing against paying a $4.00 per person for day trips; Ifind it bazaar some people are actually complaining about paying a $4.00 fee. My issue with the process was just that; the process; When a 7 mins thing turned into a 2 hours wait. We the charter businesses are charging people a cost for the time hired; that’s a business; Paying the tax to customs is also a business. Also the businesses that should be worried are those who lack of customers service; We always make more than what we pay for cruise permits because of our services. However the Government made the decision after numerous conversations with different sectors; I don’t believe it’s for political reasons just listening to the people. Also good timing as the cost of marine fuel might also be on the rise. I just can’t believe people complaining about spending $4.00 when the average mix drink is over $5.00.

    I guess Mr Penn will rally the troops to waive all penalty fees issued by FSC for BVI Business companies for the rest of the year. If I was to post complaining about all the various penalties levied by the FSC Broderick would not agree, he would say that is the law and enforcement is key to maintaining order but he wants everybody else to ignore their rules.

      He is right, a fine was the correct measure, in a matter as sensitive as this, we have visitors already here on vacation or on they way, this should of been an in house matter!

    From Mr. Penn’s post I don’t think he’s advocating for anyone to break the rules, he’s simply saying impose a fine on the operators if they’re not compliant.

      The law says what is to happen when you breach. Penn is not the law and should therefore not advocate anything other than following the law the same way we have to follow all. FSC’s laws.

      I agree with paying a fine but that does not mean they are free to go. They still have to abide with the law of having the vessel in the territory.

    I commend you J, Winter for standing for what is right. I'm so tired of ppl playing politics instead of upholding the law and ensuring that our country benefit from those who are capitalising big time in our waters. Broderick needs to have several seats because we these same waters that tourists crave and will always crave is what have made us who we are today. The Government must ensure that we acquire adequate revenue from our waters because these business are. When there's smoke there's always fire.... speaking contrary would only mean, one has something to gain themselves. I'm so sick and tired of persons only thinking of self instead of country. People open y'all eyes and ears to the words not be spoken...some people just think others are so naive and stupid that they can't see through the BS.

    I kind of agree with Mr Penn partly with respect to how action were taken on the part of the officers,Given the situation where a company is in contravention of the customs rules and regulations under the management act,the officer in charge should be more tactical and diplomatic especially if the offence is commited by a company where there is a negative impact on the tourism sector.

    I would like to presume that all the customs and marine police boats are also compliant? asking for a friend, as I know most the police cars are not road worthy... and don't seem to have any DMV sticker no more while they ride around without any seatbelt

    Does anybody know how many incidents with charter boats over the last 20 years would have been prevented if Customs had enforced these safety regulations earlier? I think we should concentrate on the private go fast boats, as they are more accident prone.

        Love this post; straight and to the point!! White supremacy and entitlement rearing its ugly head once again! This nonsense with charter companies been going on for years and nothing was done about it! Furthermore, water taxis from St. Thomas was/is an issue and local carriers have been sounding the alarm for years! Estimated revenue of charter industry $120M per month according to Officer Winter; now what BVI is getting is a drip in the bucket. Let them go to USVI; taxes over there will hit their bottom line! Remember, BVI has no corporate tax!

    from after the 2017 hurricanes some of us have hardships yet government departments expect to be paid(along came covid 19 with shutdown of the economy but some departments looking to be paid)

    So if the charter companies affected decided to laid off workers I guess customs will rejoice. They will have their salary at the end of the month. Have anyone give and considerations to the workforce that might be affected. Irma, Covid and now this who will help those workers. Stimulus packages again?

    Nonsence that the charters companies not in compliance have to pay a fine. If the boats are at the dock because they do not have clearance to go out why are they being fined. It's not like they went out without a permit and break the laws. They are at the dock being detained.

    From what I've understand, some of these companies were find before and given the opportunity to fix said issues. Customs had meetings where these companies were warned and given the opportunity once again to sort themselves out and didn't. So now Customs did what they are paid to do, which was stopping delinquent charters from possibly putting person's lives in danger and that's a problem?
