Bar fight: Man in court for kicking woman in lower back
The alleged altercation took place in Fat Hog's Bay, East End at a bar, where it is alleged that on July 18, 2015 Lettsome kicked Penn in her lower back, following which she made a report to the East End Police Station.
Lettsome, who pleaded not guilty to the charge, said that he acted in retaliation to a “hard hit” on the right shoulder that he allegedly received from Penn.
Taking the witness stand, Penn said that she knew the defendant for a number of years. She told the court that the two of them had a “friendship.”
Asked by Crown Prosecutor Annjel X. Flax-Solomon whether she saw the defendant in court yesterday, she first said, “I don't know. It look like him but I don't know.”
Trouble sleeping
According to Flax-Solomon, Penn was at Vernon Malone's bar in Fat Hogs Bay on July 18, 2015. She said that when she was about to leave the bar the defendant 'hailed' her. The court heard too that Penn gave the defendant a light tap on the shoulder and the defendant allegedly kicked Penn on the lower back.
The court heard that following the alleged kick, Penn went back to the bar area and sat down in pain and the bartender reportedly advised her to go to the police and make a report which she did.
Penn told the court that as a result of the events that unfolded on the day of July 18, 2015 she has had trouble sleeping.
The woman who appeared distraught broke down several times in the courtroom and had to be led outside to regain her composure.
Upon finding her voice again, Penn told the court, “I would like to tell the court that this individual continues to torment me and I need the matter to stop.”
Attorney at Law for the defendant, Stephen R. Daniels in cross examination asked Penn whether she had been drinking earlier at the same bar. To this she responded saying that she drank whatever she paid for.
“Sometimes I feel good to drink something,” she said. She then admitted to buying and consuming three shots of Brugal.
“Would you agree that you were feeling 'nice' after the two glasses of Brugal and gave [Lettsome a hard hit on his right [arm]?” asked Daniels. “I am suggesting that you hit him hard on his hand and then he kicked you,” Daniels put to the witness Ms Penn.
“Your client is lying. He kicked me inside the bar and he had no reason to do it," she replied.
Daniels then asked her whether she could recall holding on to Lettsome's buttocks and squeezing them in a nearby supermarket.
Her response to the question was an emphatic “no.”
The parties are to return to the Magistrate's Court on June 8, 2016.
