ROAD TOWN, Tortola, VI- Nearly three years after popular local musician and volleyball player Frandy M. Martin Jr lost his life in a boating collision off Duff’s Bottom, Tortola, businessman Andy Morrell has been found not guilty of manslaughter.

The not guilty verdict was reached by a 9-member jury in the High Court today, Thursday, July 18, 2024.

The tragic boat accident occurred around 6:30pm on Saturday, October 16, 2021, and involved a powerboat named Yeya and a 40-foot Sunseeker yacht named Bayou.

According to reports, the yacht allegedly collided with the small powerboat with about three persons on board, almost cutting the powerboat in half.

Out of the three passengers on the powerboat, Mr Frandy Martin Jr, suffered severe injuries and later died.

Several persons on the Sunseeker yacht also suffered minor injuries, and two reportedly required medical attention.

Morrel denied being @ the wheel

During the trial, Mr Morrell denied being at the wheel at the time of the accident and argued that the Yeya failed to give way.

He said the owner of Bayou and captain, Graham Stanton, had left the wheel to go to the restroom when the accident occurred.

Morrel also said Mr Stanton did not stop to render assistance despite him asking Mr Stanton more than once to go back to see if anyone was injured in the other vessel.

Kings Counsel Sandip Patel prosecuted the case on behalf of the crown, while Kings Counsel Charles Bott was Mr Morrell’s attorney.

      Now what bulls*** I.just read, why was Mr Burrel targeted as he was not the Captain, why was the other guy allowed to leave the country just like that, what *&.kery is.this?

    Expected this outcome! Why charge morrell for manslaughter when he was not the one sailing the vessel. Law enforcement has to do better with some of these charges they bring. This and many other slip up cause the prosecution to loose many cases. No justice for Frandy!

    Justice served. Morrell is free. Very sad that Frandie lost his life but poor police work abetted by the treachery of the Stanton led to another miserable effort by the DPP. Mr Morrell but be mightily relieved.

    I don’t believe what Morrell stated stated that Stanton went to the bathroom and left the boat running on its own. really? Who would do that? So Stanton is the murderer who would not go back even after Morrell said he asked him to go back twice, to render assistance. Will Stanton get prison time? That was a hit and run thinking he would get away with this horrific crime. Black Lives Matter too!

      Don’t keep that hatred for white people burning you. There is another Captain that needs to be charged for our friend Frandy’s death, the one on his boat.

    It is clear that the DPP that made the determination to prosecute this hopeless case - as she reminds anybody who will listen, she and she alone is the only person that can determine whether to proceed with a prosecution.
    It is less clear why she did not prosecute it herself. Did she bring in an English KC to prosecute it because she has lost her nerve in Court or did she want to save herself the embarrassment of losing another case herself. I hear that the English KC expressed severe doubts about whether the prosecution should be continued but the DPP was determined to proceed.
    In summary, the DPP has lost yet another case (and three of the four charges were dismissed before the defense started its case because there was simply not enough evidence to allow them to continue).
    We really really need to fire the DPP. She is a national embarrassment.

    I am not a lawyer, however, based on the evidence provided in the case that stated that the captain left his boat unattended and went to the rest room when the accident occurred is a clear case of carelessness. If the captain is unable to take control of the boat because he has to go to the rest room, then he should have stopped the boat and signal to other vessels that there is a case of emergency on his vessel. To leave the vessel unattended is a clear case of carelessness on the part of the captain. The state should file an appeal of the verdict.

      Totally agree.
      Richard DiNapoli, a maritime consultant and former shipmaster from New Jersey, provided critical testimony on Tuesday, July 16, in the High Court. He indicated that the Yeya vessel violated six rules under the International Regulations for Preventing Collisions at Sea, based on his recreation of the accident from the evidence presented. Including traveling at a speed of 29-30 knots before the collision.
      So why wasn't Ray Brewley, the captain of the Yeya (the vessel that Frandie was on) charged???????

    Actually, I thought from initial reports there were more people on board (kids?), but somehow the numbers have changed...
