Accused in RiteWay heist claims life was threatened; secures bail
The incident allegedly occurred in October 2013 in the vicinity of Road Reef Plaza in Road Town.
According to the allegations read by Crown Counsel Herbert Potter, on October 11, 2013, the defendant allegedly had a meeting with an unknown person in a black pickup and the unknown person told the defendant that they wanted to rob the RiteWay van which would be driving on October 13, 2013.
Magloire allegedly claimed his life was threatened if he did not go along with the plan. According to court records, the unknown person contacted the defendant by phone and he was told to pick up another person.
He then went to the location of the first unknown person the next day and took the person to Huntums Ghut where he was given a cellular phone different to the one he had and told that the signal would be the ringing of that phone.
The unknown persons allegedly met with the defendant to execute the plan.
On the day in question, the defendant reportedly went to work and proceeded along his route as per normal visiting and collecting cash at RiteWay stores in East End, Road Town and eventually Road Reef.
It was here that Prosecutors alleged that one of the unknown persons knocked on the window of the vehicle the defendant was in and told him to leave. He allegedly did so and a masked man drove off with the cash.
The matter was reported and an investigation launched. The van was later found without the cash. The defendant then reportedly visited the Road Town Police station and gave one account of what happened.
On October 17, 2013, the defendant allegedly had another conversation at the station with officers and they informed him of certain things and he reportedly consented to give an interview under caution.
He allegedly confessed to being involved in the robbery during the interview. He was invited to the station the following day where he was arrested on the charge of conspiracy to commit robbery.
The Crown initially objected to bail noting that the defendant may interfere with the finding of the unknown person at large and also because the money stolen, reportedly declared to be $42,000, remained unrecovered.
The defendant was, however, granted $15,000 bail with two signed sureties. He was asked to submit his travel documents and report to the Road Town Police station twice per week.
Magloire was recently fined $5,400 for possession of guns and ammunition in an unrelated matter.

And with that in mind, can someone explain why (considering he has already been convicted of possession of guns and ammunition) that he was granted bail on a robbery charge?
Is it because he is a person of such good character that the court believes his "they made me do it" story? Phhhtttt
