50-year-old man allegedly assaulted minor

ROAD TOWN, Tortola, VI - A Guyanese man, who now holds residency in the Virgin Islands, is facing charges of indecent assault on a minor, and was granted $70, 000 bail with two signed sureties when he appeared in the Magistrate’s Court yesterday July 18, 2012.

Senior Crown Counsel Janice Stoutt informed the court that the man’s charges are results of incidents that allegedly occurred in November 2010 and April 2012.

In reading the statements given to the Police by the Virtual Complainant (VC) against the accused, Ms. Stoutt read that on several occasions the accused, who was in a relationship with the minor’s mother at the time and lived in his house on the eastern end of Tortola with the minor, would enter the VC’s room at nights while the mother was at work, and tried to slip under her sheets.

The Court was informed that the complainant was awaken by every attempt made by the accused and started to lock her bedroom door as a result of the harassment, but the man was allegedly in possession of a key.

It was further stated that the minor made complaints to her mother.

The court heard that an argument took place, where the man allegedly told the mother that it was his house and he went where he wanted.

Following investigation conducted by members of the Royal Virgin Islands Police Force, Ms. Stoutt stated that the Police came aware of the second similar incident of November 2010, where the defendant harassed the minor again.

The court was also informed that the accused tried to show the minor how sex is done by viewing porn.

In relations to the charge, Yohance Cave, who represented the accused, told the court that the charges were brought against his client because he asked the complainant to leave his premises.

In efforts to get a fair bail, Mr. Cave disclosed that his client, who has been living in Tortola since 1982, is firmly rooted in the jurisdiction and has never been charged with any offence other than traffic.

The case was adjourned until September 25, 2012 for a Preliminary Inquiry to ascertain whether there is enough evidence for the case to be transferred to the High Court.

The accused is to visit the East End Police Station every Monday, Wednesday and Friday, between 6 a.m. and 6 p.m., surrender all travel documents and refrain from any direct or indirect contact/confrontation with the alleged victim.

The name of the accused has been withheld to protect the identity of the minor.

        So what if he has BELONGER status? He did not uphold the laws of the land, therefore he is not a law ABIDING citizen. BTW you must be GUYANESE.     How he was granted bail and BVIslanders are being denied what kind of none sense is this others are being sent to Balsam Ghut even if they are given bail they spent time Balo. But the prison is over crowed and ain't got space so he's spared the legal system is design against BVIslander and it's a proven fact...

And you wanna talk about facts? Here's a fact for you! When a 'LOCAL' , B.V.Islander or belonger or (what ever yall call yall selves) is charged with rape it usually gets BRUSHED UNDER THE MAT! especially when the child isn't from here and the person's last name is well KNOWN and the ones that don't get brushed under the mat, they get like 3-5 years in yall LUXURIOUS PRISON!

    Too much of this nonsense happening in this place. Stiffer sentencing needs to be in place instead of giving them 8 years in jail. People like these men need to be locked up and throw away the key or better yet give them the Lorena Bobitt punishment.
